"Let’s put the girl who cried ‘wolf!’ on trial instead"

Her name is Maria Di Toro, the woman who claimed she was raped by Greg Kelly.

In the interest of justice, as well as protecting the safety and sanctity of all women, I’m begging Manhattan District Attorney Cy Vance to prosecute Di Toro, 29, a paralegal who wants to be an actress and model, to the fullest extent of the law.

The girl who cried “rape’’ was almost believed. She twice told prosecutors a consistent and credible story that, were it not for the exertions of the DA’s office, might have cost a good man his liberty and sent his career into ruins.

Di Toro last month falsely accused Kelly, 43, the handsome son of Police Commissioner Ray Kelly and a “Good Day New York’’ anchor, of raping her.

Whether she was motivated by anger, lust or fear of losing her boyfriend — or, as she claims, sexual amnesia — no rape occurred.

It was a misrepresentation — I won’t use the word “lie” — that many responsible adult women I know fear could make us all look thieving and dishonest.

Di Toro claimed that she got drunk and was taken advantage of by Kelly on the night of Oct. 8, 2011, as she eagerly stepped out on her boyfriend. But fortunately, her story stank to high heaven.

For here was a gal with a live-in lover who admitted she picked up Kelly on a downtown Manhattan street with the cry, “You’re so cute,’’ like some kind of overage groupie.

Di Toro proceeded to send him two days’ worth of racy text messages, in which the duo discussed things they wanted to do naked.

The climax, if you will, came as Di Toro went out for drinks with Kelly at a South Street Seaport dive. Afterward, she took the anchor to the law office in which she works because, unlike the single Kelly, Di Toro had someone waiting at home.

At the office, the pair engaged in sexual intercourse. They did it right in the office of Di Toro’s boss, leading to all sorts of unappetizing sanitary questions.

She wasn’t done. Di Toro continued to send sexts to Kelly — 17 in all. She asked him if they might hook up again.

Three months went by.

Di Toro now claims she got pregnant and had an abortion. Suddenly, her mood toward Kelly flipped 180 degrees, changing from possible anger — why doesn’t anyone use a condom? — to devastation.

After her boyfriend found out, and Kelly vanished, she decided that the sex she pursued so wickedly wasn’t lovemaking at all, but forcible rape.

In the meantime, Di Toro’s man confronted Ray Kelly at a public event with news of his son’s sordid sexual experiences with his own girlfriend.

“You ruined my girlfriend’s life,’’ he charged. It makes one wonder what kind of fiction Di Toro had spun.

Even after the time spent sexting Kelly, followed by a booming silence, Di Toro has hidden behind a veil of anonymity that Kelly, a totally innocent man, was never afforded.

Enough!

This week, the DA’s office put out a statement saying Kelly did nothing wrong.

“The established facts do not constitute a crime under New York criminal law,’’ wrote DA rep Joan Volero.

A source put it this way to The Post: “The lustfulness” between Kelly and Di Toro “was mutual.”

Well, the DA’s office doesn’t want to deal with it anymore because, however improbably, prosecutors believe Di Toro is telling the truth when she says she can’t remember having sex with Kelly. She just knows they did it.

There are two ways one can prove a rape: forcible compulsion (of which Kelly was never accused) and physical helplessness. Well, the pair drank little. Being a lightweight is no proof of sexual assault.

“Not being able to remember is not tantamount to rape,” said a source.

Prosecutors, who must possess mind-reading powers to glean what’s going on in Di Toro’s head, have declined to charge her with filing a false criminal report because they think she believes she’s telling the truth.

It’s not good enough.

It’s time to protect true victims of sexual assault by ripping off the veil that only encourages gals to make untrue claims. Who will believe a real victim now?

Di Toro is, at best, a confused soul who irrevocably harmed a man’s reputation by thinking only of herself. At worst, she lied when she didn’t get her way.

If she really believes she was attacked, then Di Toro has nothing to be ashamed of. If she made up the story, then protecting her only serves to tell women that this kind of demented behavior is OK.

The DA must take a stand against false claims leveled against men, the same way he would uphold the right of any other minority to not be harassed and scorned because of physical appearance.

Di Toro must face the music.

Most guys falselly accused of rape when choiced with the fight or flight option, choose the flight option. They Run and hide from the the world for the rest of their lives, because they understand the perversion is NOW rooted into the very fabric of our law enforcement.
Very few stay and fight the perveted juggernaut that is ruining multitudes of innocent (Now mostly college age guys) lives.
Americans have a constitutional right to not be prosecuted on false accusations.
If its federal pork bloating dollars that is fueling all the perversions and manufactured statistics in American law enforcement..Then those perversions need to be addressed.
End the senseless violence, Break the missinformation Alliance!!

I was disappointed, but not very surprised, to find a lot of nonsense in the comments there, including one from a woman who whines about "the biased language against the victim, and for the alleged rapist". Get that? Di Toro is somehow cast into the role of "victim" even though she instigated all sexual contact and followed up their tryst with days of explicit sexual texting. Other commenters claim that Kelly is morally depraved because he, a single man, accepted the advances of a willing and attractive woman. Give me a freeping break!

What a fool! But he was lucky -- at least he was able to have his name cleared without it costing him everything he has...unlike so many other falsely accused men.
And maybe he has learned his lesson about today's Modern Womyn (and will keep it in his pants from now on).

He should take The Red Pill and shun all further contact with Western Womyn -- the Good Lord only knows that he is old enough to have lost his 'hormone haze' and is capable of seeing Modern Womyn for what they are.

I was in complete agreement with the article until you hit me with "they think she believes she's telling the truth". For me that raises a red flag.

--- Maybe she's a better lier than the average female being a paralegal and knowing a bit more how to play the game, she's the daughter of a prominent attorney, and she's an aspiring actress and model. Has she studied acting?

"There has to be a good reason not to prosecute".
--- She has this feature called a Vagina that men do not have. Besides, if she was prosecuted NYC's feminists would be outraged, demonstrate, and cause headaches for the politicians.

Definitely a “red flag”. One wonders how anyone could actually believe that she actually believes that she is telling the truth that she doesn’t remember having sex with Kelly.

Even though they had been out drinking together, she was certainly cognizant enough to know that they couldn’t go to her place (where her boyfriend was). She was also able to get herself and Kelly into a secured building and office, not exactly the handy-work of a stumbling drunk.

Yeah, the most logical thing to do with that claim of hers is to simply call BS! On it.

But, while I don’t know what the exact statement the DA made regarding their “belief” in her veracity (we have only Andrea Peyser’s recounting herein), but it seems to me to be the sort of double-speak typically used by officials who don’t dare publicly state what they actually think. I’d venture that the assertion by the prosecutor that they believe she doesn’t remember the incident is more likely their way of saying that “we don’t believe we could convince a jury that she absolutely DID remember” (which, BTW, would be the necessary criterion for convicting her against the “beyond a reasonable doubt” standard).

No one speaking on behalf of the DA’s office is going to come right out and say, “we know she’s lying, but we’re afraid we could not convince a jury of it” – but that is the very sort of thinking that goes into the decision as to whether or not to prosecute many a case*. It doesn’t make any sense to commit to the expenditure of time and money (not to mention the time of citizens called for jury duty) to take a case that they are sure they will lose to trial – especially if the charge in that case is a misdemeanor for making a false report to police.

* Sorry if that rubs some of you the wrong way, but there is a certain logic in declining to take certain cases to trial – and it cuts both ways, both in declining to prosecute false accusers, and in declining to prosecute some accused of rape.

The women, who was (presumptively) raped made a number of missteps which lead prosecutors to believe that she would not be believed by a jury, so they declined to prosecute the case.

I wish that I had invested in the video game industry ten years ago since the demand seems to keep increasing with the criminal laws that are increasingly unjust and misandrist. Man-up, date/marry a modern womyn, and risk a FRA? No way. I'll go play my new video game or hang-out with a male friend and go salmon fishing.

Careful, or I'll drag out my soap box and start ranting about the absolute need for new laws which make false reporting of felony crimes also a felony charge, and which will officially recognize the falsely accused as the primary victim of those felonies (entitling them to both victim's assistance, and a say in the decisions regarding the prosecution of the case).

Slw, no. That explanation makes perfect sense, thanks. It was definitely drunk regretable sex. Even if she was too drunk to be aware of having sex, I don't have a bit of empathy.

And yes it can work both ways. I truly believe that's what happened in the case involving the NY maid.

That's sensible advice, of course, but not something most men would choose to do. My advice would be more "Have sex but for God's sake be careful!" Starting with wearing a condom. And, it's totally not romantic, but it would make perfect sense to secretly (audio) record the encounter as a possible antidote to future lies on the woman's part. Make sure to call her by name and somehow include the date and time of the tryst. She might claim the tape is faked, but it could still carry a lot of weight when the phony accusations start to fly.

--- I think some of digital recorders will automatically log the date and time. Why keep recording limited to when having sex? Womyn can and do frequently make FRA without there ever having been any physical intimacy.

American Gender-Raunch gain alot of "Empowerment" by perverting who American law enforcement can charge and cannot charge, and they will fight tooth and pervert to keep this missinformation Alliance from the eyes of the public and away from constitutional scrutiny.
