Eleven-years-old, and she's making a false allegation of rape. While there is no mention of why she made the allegation, it seems obvious that she knew the kind of response she would get.
Based on the results of what I can only assume was a rape kit/SANE exam, that there was no DNA evidence, or any other indication that a rape took place. When the girl was brought back in and confronted with that information, she admitted to making up the story. Why she did this is still unknown.
This is the second false report in the area in the last couple of months. A 15-year-old girl made up allegations in March, and was charged with filing a false police report.
The question that this leads to is, what type of punishment would be appropriate to deter these girls from claiming rape in the future? Because if they get a slap on the wrist, it will drive home the point that they can get away with it. So does anyone have an idea of an age appropriate punishment that would both get the message out that false accusations of rape will be punished, but will also deter future false claims?

How can we deter future false accusations of rape/sexual assault?
I believe, if the false accuser is a minor someone MUST teach the child the seriousness of making such false accusation and what the consequences (which MUST be be made harsher) will be. Then we find out who taught them to make such false accusations and severely punish them so they will seriously reconsider teaching any children to lie about something as serious as rape/sexual assault.
I believe if the false accuser is an adult, they should have the sentence that would have been imposed upon their victim imposed upon them plus any/all time spent in jail awaiting trial. They should also, after serving the imposed prison term, have to register as a false accuser for the rest of their life.
I know this seems way too harsh a solution but, the penalties for rape and sexual assault are almost as severe as the penalties for murder and attempted murder.
False accusations of rape/sexual assault MUST BE STOPPED! Too many people's lives have been destroyed/ruined.
I am a big proponent of shaming as a form of punishment. Introduce false accusers to the public with a sign that says, "Hi, my name is (fill in the blank) and I lied about being raped." And list the cost to the taxpayer.
For those who actually accuse another of rape add to that "I falsely accused (a male/female)of rape" and list what happened to the accused at their expense and how much the investigation cost.

if 11 yo isn't too young to get an innocent man sent to prison for 15 years, it isn't too young to do 15 years herself.
I personally think that a little girl cannot do such things alone. We must investigate who are the elder people behind things like that.
I accept that there must be a punishment for falsely accusing. Because of women and girls who are leveling false allegations are not innocent.

Fourth, of course there might be mitigating circumstances to excuse her act. That would be up to her to present such evidence. All things being equal, however, she should be treated the same as an eleven-year-old boy accused of rape. To the extent "she is still a child," so is he, and if we are going to be lenient toward one gender, we need to be lenient toward both. Frankly, if society saw a girl in shackles the way we saw an 8-year-old and two 9-year-old boys in shackles a couple of years ago after they were charged with rape, perhaps then society would begin to question the wisdom, the prudence, and the justice of our zero tolerance approach to sex crimes. Because make no mistake, false rape claims are gendered crimes.

Good question: Candie the writer of the piece did not seek out the reason why she made up the story even to write 'no-reason' given if that was the case.
Punishment? I really don't know since I am no expert on kids and especially tween/teen girls that appear to be sometimes from another planet. Perhaps sentence her to spending her summer vacation doing community service in a non-fun job after jailed for one week in Juvenile Hall? Her name and face can also be put up on a big community billboard (forget the privacy protection bit as she was no victim).

After mulling it over a bit, I’m going to have to second Brandon’s thoughts here.
With both of the two cases of under-aged girls falsely crying rape, there are two hurtles which cannot be easily overcome in seeking a more appropriate punishment.
First, and most importantly, if the top charge with which they can be charged in their jurisdiction is a misdemeanor level false reporting charge (as it is in the vast majority of locales in the USA), then the sentences that they would ultimately face, considering that they are likely both “first time offenders” would be little more than fines and possibly community service under a suspended sentence.
Secondly, as juveniles, they would face even lighter punishments under legislatively decreed sentencing guidelines. They could face doing some time in a juvenile detention program, but most judges would not consider such a sentence for first-time offenders charged with misdemeanors.
Thus, perhaps the most meaningful punishment (other than the fines their parents would have to pay) that could be imposed would be to make them, as part of their “community service” to wear signboards with the information detailing their crimes and the cost to taxpayers.
Many teenaged girls don’t give a sh*t about what their parents have to pay to indulge them, thus they would be unlikely to feel “moved” by the fines that could be imposed. But, the shame of having the public - especially their peers, family, and neighbors – seeing them “announcing” what they’ve done, and what it cost would be a very personal sort of shame for them.

Have you ever considered taking an adult literacy class. It’s never too late to learn how to read. If you could read, then you’d have already known that in both cases detailed above, the police were the ones who “outted” the FRA’s (no false stats, no empowerment gained, no money exchanged – none of your fantasy’s come true here). Could you save the BS for a post where it might be more appropriate?
This is a very serious crime and it warrants a very serious penalty, including jail time.
It's not uncommon anywhere these days. We had a big case come up here (http://wapo.st/iS1Fwb) and basically there isn't any punishment for the girls involved, but the teacher's life has been made a living hell. No wonder so few men are signing up to be teachers.
It's not an isolated incident, either. The family that lives next door to my ex-wife has a daughter who made a FRA against one of her teachers. She fessed up to the falsehood after about nine months, but by then the guy had been forced to move out of his house, had lost his job and so on.
The reason for all of this, I think, is that one the one hand we are informing girls about their rights with respect to rape at an early age -- not necessarily a bad thing. But the problem is that these girls are not, of course, stupid, and they realize that these rights are a thing of tremendous power for themselves, and, being immature, they use them to exercise their power for various reasons (to get attention, to lash out, to get revenge on a teacher they don't like who reprimanded them or gave them a bad grade and so on). But it happens a lot -- even a lot more than is reported in the press in any detail.

SLW, we are certainly aware that the minimum sentences for false reporting would need to be altered to give effect to Prof. Dershowitz's suggestion. And, no, I've never seen this happen anywhere.
Those sentencing statutes were enacted at a time long before false accusers were handed so much power to destroy the lives of the innocent. I’ve mentioned before that while I’d like to see felony-level statutes akin to the UK’s Perverting the Course of Justice enacted, what I’d prefer to have would be laws that would make implicating another person or persons via a false allegation – directly, or indirectly as a outcome of the false allegation - not only a felony, but a crime which would recognize the falsely accused innocent person(s) as the actual victims of the crime.
One problem I believe that we have long-overlooked is that, under current law, making a false report to police, is not considered a crime against anyone who is falsely accused or implicated, but rather a crime against the state. Filing a false report with police is a crime which (for the purposes of the Criminal Justice System) only recognizes the police as the victims. Even Perverting the Course of Justice, unless specifically designed to address the falsely accused as being victims, is seen as a crime committed against the interests of the state.
Those who are accused or implicated, regardless of the harm that may befall them, are seen as being the victims of Libel, outside the prevue of Law Enforcement. This means that not only is their course of redress seen as being via the civil courts, but they are not recognized as a party with standing as to in the consideration of charges which may be brought against their (false) accusers. Now, the police, prosecutors, and even a judge may chose to consider them as a victim, and consider their statements as to the punishments to be imposed – but they are not legally required to do so as they would be under state laws as Colorado’s Victims rights Act.
This, to me, is a serious oversight which ought to be addressed. Not only would falsely the accused be given a voice in what would be done with their false accusers, but they would also then be officially recognized as victims eligible for compensation under state-funded programs. It would also open up the door for prosecutors to request restitution for the victims as part of any adjudication – as they now can do for victims of, for example, the victims of a auto accident which lead to criminal charges.

This is my response to the suggestion that the police are the good guys here for finding the FRA in any instance.
For all the alleged crimes that cross the police and prosecutors desk there are only so many that hold the minimal appearance of being true,those that are so outlandishly false that the the court system would look the buffoon to prosecute must be let go to avoid loss of power.
So many borderline cases where innocence should be presumed are prosecuted successfully.
Your local prosecutor,like all prosecutors,hold a %98+ conviction rate.
Many of those are plea bargins to avoid a system that there is no real justice within.
So let's hold off for the moment on clapping those cops on the back for finding one element of truth and deciding to come forth with it,when overall cops lie every day to get innocent people prosecuted.

The idea that children who commit crimes should be charged as adults is invariably a silly idea. The reason children are not tried as adults is the very same reason we don't allow minors to vote, purchase alcohol, enter into contracts etc. It is because minors are assumed to be less mature and competent to handle certain matters. It is absurd to suggest that minors should have none of the legal rights of adults, but still have all the same responsibilities under the law.
The fact that other moronic sections of the community would gladly throw innocent boys under the bus does not make it any better to subject girls to similar treatment. This does seem to be a case of 'two wrongs don't make a right'.
Having said that, I think it would be okay for this girl to do some time in a juvenile detention centre. Although she should not receive the same sentence as an adult should receive for the same offense.
