Ex-judge forced to apologize for not being tough enough on alleged sexual assault

Read the entire article, but this is the part that really should be focused on -- this is the example the man used that got him in so much trouble:

A 20-year-old man is "at a party, there's a lot of sexual innuendo, one of these women is being very aggressive with her boyfriend and they're drinking a lot, the boyfriend passes out, she goes, gets into bed naked, he goes up, he's thinking he's going to be able to, that she'll probably agree to have sex with him, he fondles her privates, and she wakes up and tells him to go away, and he goes away.

"They report it, he's charged with sexual offence, he has digitally penetrated her, the Crown prosecutor says this is a digital penetration of a woman's vagina, he should go to jail for three years, that's the starting point for this sexual offence.

"And I'm looking at this 20-year-old, socially inept young man, and his offence is a sexual assault and it's one that they consider a major sexual assault because it involves digital penetration. I don't think in those circumstances that what happened there should put that young man in a penitentiary for three years."

Wow, the comments on that article are surprisingly vicious. I guess the MRM's progress isn't really having much of an effect on Canada yet.

Well done for the judge to talk with some common sense. He even stood his ground (although he apologised if he'd caused offence, fair enough)about judges being able to use their discretion.He was clearly given an ultimatum about losing his job, and he still said that he was right about his position.

I agree with him completely. Making a pass at someone doesn't make you a sex offender at all. The gut was told no and backed off, what more do you want? Didn't he do the RIGHT thing? There is such a thing as overstepping the mark and I'm sure a young man on the receiving end of such an allegation would think very carefully before repeating his actions.

3 Years? Like I say, common sense.

If the sexes were reversed, this wouldn't gave gone beyond the police trying not to laugh in his face.

Eh. Although the protests are stupid, if this guy really fondled a sleeping girl, especially one not involved with him... it's hard to feel sorry for him.

It's not really rape, but it is sexual assault. I don't wish to necessarily be soft on crime, and maybe 3 years is too much, given that women do similar things and don't get penalized AT ALL.

The judge is right, and the guy was dumb. The protesters are idiots.

And zarko, while I see your point, I have heard of guys who do similar things and women will accept it if he is especially an alpha. So slippery slope, especially if this scenario did happen.

He backed off after she said to back off so that should be good enough.

I read the quoted section 5 times and I don't see a single thing the man did wrong in that situation

from my understanding:
she went to bed completely naked, which most people don't do
her boyfriend wanted sex, was drunk, saw her naked, played with her a little
she said no, and he immediately backed off

if anyone really thinks that this guy did anything wrong, you are a sadist. just imagine if the genders were reversed, not that any such situation would ever occur in this manner if the genders really were reversed. a guy goes to bed naked, his drunk girlfriend finds him and jerks him a little until he wakes up. story over, you know what happens next

I'd argue that if the genders were reversed (the guy went to bed naked) there is a solid possibility that the guy would still end up being charged for sexual assault (because he went to bed naked beside her without her consent)

There are a lot of shocking nuances that were not described well in your article here.

a) confounding light transgressions with serious violent crime

b) misandry (not forced to excuse for being lenient on woman that dilacerated a man's face)
