Mother of three jailed after making false gang rape claims - to win back her former lover

A young mother who falsely claimed she had been gang raped has been jailed for six months.

Kay Hoofe - a mother of three, including a nine-week-old baby - lied about being attacked after police were contacted by her mother.

The court heard that Hoofe claimed she had been raped so the father of her two youngest children would get back together with her.

The lies led to one of her alleged attackers being threatened by members of the community. He voluntarily went to police to give his side of the story.

A court heard that the false claims caused him problems with a contact application over his child - although they were resolved when Hoofe's lies were exposed.

The gang rape never took place and Hoofe, 24, of Briar Grove, Leigh, had consensual sex with the man quizzed about the 'attack'.

Rob Altham, prosecuting, told Liverpool Crown Court that in August, police received a call claiming Hoofe had been raped by five men.

Officers visited her and she said that the previous night she had been in a Leigh pub with a friend, who left. She went to another pub to buy cigarettes.

Mr Altham said she claimed she was forced down a side street by five men who began to attack her.

He said she had claimed that two of the men raped her in the street. Afterwards they called a taxi and went back with her to her home.

While there, she was raped again before the men left, she claimed.

She repeated her allegations to officers and gave four names. The court heard that people in the community accused one man of raping her. He went to police to give his version of events. He was interviewed under caution but not arrested.

Officers studied CCTV footage and found nothing to support Hoofe's story, and witnesses did not support her allegation. She was interviewed under caution and initially maintained her story but later admitted she had been lying.

She pleaded guilty to attempting to pervert the course of justice.

The court heard that Hoofe had consensual sex with the man but claimed she had been raped so the father of her two youngest children would get back together with her.

Richard Dawson, defending, said she never intended the false allegation be brought to police attention. Her mother overheard her arguing with her partner about the rape claim and without Hoofe's knowledge rang police.

'Hoofe did not know how to extricate herself from the situation and made this ludicrous suggestion,'he said.

Detective Sergeant Nigel Rigby, of Wigan CID, said: 'This web of lies could have had dire consequences for Hoofe's alleged attackers. The stigma of being accused of an awful sex attack is not easy to shake off.

'For somebody to make up a story and falsely claim they have been raped completely undermines genuine victims.'

Yes, for six months.

These sentences are far too lenient. Once the MRM gains ground, a central plank of our programme will be effective deterrents against false allegations. Ten year minimum for women making false allegations sounds fair to me.

Even if you think ten years is too harsh, notice one thing.

Imprisonment is the most I would ever advocate.

Unlike those nasty femmorhoids, who advocate mutilation for those simply accused, not even convicted.

They belong back in the dark ages, when that kind of thing was acceptable.

As a falsely accused, one the one hand I agree with you, hell, I'm all for the firing squad.

On the other hand, as I have said before, even one day imprisonment for "Perverting the Course of Justice" (eg lying or falsifying) is in many ways a life sentence.

It never becomes "spent", and if you sit down and think about it, it sentences you to a life time in the gutter, with many of the protections of society removed from you.

meanwhile caller ID has just flagged up the number and address, and the name, Kay Hoofe, and the criminal record, 2010 HMP for PCJ

while the caller is still talking, all this is sent by computer to the police unit designated to attend.

you're fucked and only 30 seconds have passed since you called the police.

same thing happens when you apply for a job, within 30 seconds of your name going in the computer your prison sentence comes out, ching, next please.

same thing happens when you turn up at the hospital, your record comes up, you get to wait until one of the cubicles with cctv are free, and a doctor and two orderlies are free.

We live in a society that is driven by interlinked databases, and with "HMP for PCJ" on your record, basically you're screwed.

This all happens AUTOMATICALLY, and it happens faster than you or I can manually type "kay hoofe" into google in a browser and press enter and get a reply.

I would personally aim for ALL false accusers to get some sort of jail time for PCJ, even if it is only a month, before worrying about headline news deterrent level sentencing for individual cases.

an incalculable number of people, some not even born yet, have now effectively been inoculated against one Kay Hoofe.

that is no small victory.

Dammit, that's some great insight AfOR - seriously. That never even occurred to me.

The only issue is that the whole process can also work the other way, can't it - that a falsely accused who is even found innocent, can retain a record on simply having been CHARGED, and that this can be flagged up in all the instances you mentioned.

Which is obviously completely fucked up and uncivilised - and I don't use that word lightly. It is punishing innocent victims. There's no two ways about it.

Absolutely, I will fail an enhanced CRB at the moment, but trust me, that is a WORLD AWAY from a criminal record indicating a custodial sentence for PCJ.

When I was a lad you could get banned for drink driving in hampshire and move to gloucester and they had never heard of you (until you did something serious) because that's the way it was.

I _____KEEP_____ trying to tell people, the information age isn't about computers, it isn't even about databases, it isn't even about interlinked databased, it is about interlinked databases that are automatically updated.

True story, local guy, young lad, been unemployed for a while since he got 9 points (gatso) no employer insurance, yadda yadda.

So, he's been unemployed for six months so they tell him he is going on to an "action for employment" scheme, here's your appointment, hand written, 17th

cept it wasn't, bad writing, it was 11th.

11th of course he was "no show" at action for employment

action for employment computers notify social security computers, his dole claim is cancelled

social security computers notify housing benefit computers, his housing benefit is cancelled

housing benefit computers notify the city council computers, he council tax credit is cancelled and he is issued a bill for the full 1100 quid council tax.

you see?

now imagine it isn't just an honest mistake, but a "red flag" like HMP (her majesty's prisons) for PCJ

btw all the above happened to this young lad by 7 am on the 12th... took him three fucking weeks to get it sorted, and that was with people who *felt* like helping.

Six months is nothing. I'm disgusted that this criminal was able to inflict so much damage on the victims because of the ineptitude of the legal system.

What's even worse about this case is the girl is just scum. This is her 4th offense. She has threatened a neighbour with a knife and caused criminal damage on 3 other occasions too intimidate people. She truly is a blimp on society.
Too add too this the story of her ex partner being the childrens father is in heavy dispute. Also she must have been pregnant when she engaged in sex with the stranger she then accused.

I unfortunatly know the family and girl and they all have escaped prison sentances for various things. Her own brother was accused of rape, but there was not enough evidence too prosecute and the poor girl was left in a mess and with no justice.
Not a single one of the family have held down a job and all claim benefits. Disgusting

The trouble with AfOR's punishment analysis is that few people know that false accusers are "punished" in the manner AfOR suggests, so it does not serve as a public deterrent to false rape claims and does not help the vast numbers of false rape claim victims.

agreed, it is no deterrent.

but it does inoculate the rest of society against the individual FRA, and since FRA's are typically serial FRA's, it does do a lot of good.

scum is not the word i would use where ever she goes she leaves damage and trouble in her wake.and prison wont change her.i personly hope the lad involved with her leaves her for good.families like hers what are the kids goin to be like they have no chance
