Breaking news: Roethlisberger will not be charged for rape

UPDATE MONDAY EVENING: The report below was prepared very quickly as the D.A. read his prepared statement.  The following is a more thorough report from a Pittsburgh newspaper, and it contains information from a press conference the D.A. held after reading his statement: http://www.post-gazette.com/pg/10102/1049817-66.stm

My original report follows:

Baldwin County, Ga. District Attorney Fredric D. Bright announced this afternoon that Pittsburgh Steelers quarterback Ben Roethlisberger will not face charges for sexual assault. 

He explained that the duty of a District Attorney is to seek justice, and not merely to convict. He said that the sexual allegation "cannot be proven beyond a reasonable doubt."

Mr. Bright explained that the crime being investigated was rape, which requires penetration, forcibly and against her will. The circumstances do not lead to a viable prosecution. "We do not prosecute morals; we prosecute crimes."  He revealed that the "victim" (Bright's inappropriate word choice, not mine) wrote on March 17 that she does not want to prosecute.  The District Attorney later met with her, and she confirmed that decision. 

Bright explained that the investigation revealed the following: both parties had been bar hopping and drinking the night in question, and had met at different bars. They participated in various conversations, some of a sexual nature. The "victim" was highly intoxicated. Roethlisberger followed her into a small, less than five-foot wide bathroom.  "Significant questions" remain about what happened in that bathroom.  But the medical examiner found no evidence of rape.  Human male DNA was present.  But the sample was so minute that it could not yield a profile.

Roethlisberger's name made no difference in the investigation, Bright said. This was simply a charge that could not be proven beyond a reasonable doubt.

And based on all that, the District Attorney is to be commended. He did not roll the dice with a man's life, hoping that -- even though he didn't believe there was evidence beyond a reasonable doubt -- perhaps an irrational jury would.

Still, the absence of anonymity for Mr. Roehtlisberger will insure that he is forever tainted as a possible "rapist."  His reputation might never recover from this. Given his fame and wealth, he is in a far better position than most similarly situated presumptively innocent men, who often lose everything under these circumstances.

That's all we need to know. This is Big Ben Roethlisberger; we know what he does to trained atheletes on the football field. If there had been any kind of rape she would have been torn to pieces.

So, it was an accusation of (penatrive) rape, not just a sexual assault - as what little was being leaked out seemed to suggest.

Yet, this report still isn't explaining much. For instance, this past weekend, it was revealed that the surveillance camera's were not positioned to see the restroom entrance, yet we have this:

"Roethlisberger followed her into a small, less than five-foot wide bathroom."

If the camera's could not have seen this, then this must either come from Roethlisberger's acknowledgment that he followed her in, another eye-witness to his having done so, or (drum roll, please...) her simply have alleging that this is what happened.

And, I have to take some (objectionable) note of these significant things:

"But the medical examiner found no evidence of rape. Human male DNA was present. But the sample was so minute that it could not yield a profile."

The article sort of gives these two facts the "yada, yada, yada" treatment. But, they are extremely telling. By way of explainable, it should be noted that rapists (rape rapist, the kind who carefully plan their crime, and take great precautions) can and have been caught via the DNA evidence gleaned from a single hair root. Without going into detail, there are now techniques which allow a very small DNA specimen to be replicated so as to yield an identifiable profile.

And, while a SANE examine not finding any evidence of rape is not necessarily conclusive, just exactly how is it that a man (who had been drinking) could carryout an unplanned "opportunistic" rape, and not have left any (DNA) evidence?

I rather suspect that by "minute" they really mean "degraded" - meaning that what they found was too old to be replicated for analysis, but that the tell-tale "Y" chromosome could be identified, owing to it's obvious smaller size (the base pairs can be disrupted so as to be unreplicable, yet the the gross structure of the "Y" chromosome retained).

Given as I am to rampant speculation, sounds to me like they might have found evidence of sex with some man (boyfriend, perhaps - which might also explain why she would make an FRA) from days prior - but nothing from Roethlisberger.

The rest of my speculation builds upon that which I have previously proffered.

Taking advantage of her chance to be with a celebrity athlete, she women invited Ben into the restroom for sex. During the drunken pre-sex fumbling, she fell and injured herself. She lost interest in sex, and perhaps blamed him for her having fallen.

Her friends took her to the ER (for her head injury, as I recall), and, when asked about her injuries gave just enough information about having been in the restroom with a male to trigger an automatic report to police.

Still not entirely sober, she indicated to the investigating officer that there had been some (intended) sexual activity. the officers training no doubt lead the her being asked (repeatedly), "I need to know, did.he.rape.you?"; eventually evoking a yes response from her. Having already started to dig the hole, she continued on by submitting to the SANE exam.

Then, as we already know, once she'd sobered up, she became uncooperative with the police, and fled "to be with family" (aka, not have to deal with any consequence for the messed she'd made of things).

She never actually admitted that she lied, and the press seems to be white-knighting for her in leaving the matter open to question; but, the underlying message does seem to be that there was no sex, and no rape - just her lies.

Continued slander of Roethlisberger's reputation even after dropping the case is not commendable.

Just how significant is the presence of unidentified male DNA? I think it's likely that male DNA is everywhere (dead skin cells, blood, sputum, ejaculate etc.). If we have technology able to detect smaller and smaller traces of it, it's going to show up more and more (and mean nothing).

I took it differently, based on this statement:
"We do not prosecute morals; we prosecute crimes."

which I take to mean that he believes that something did happen, but that it wasn't criminal - such as two drunk people sneeking off for some restroom sex.

Personally, I too believe that something did happened that night - Roethlisberger and the women intended to have (consensual) sex. But, then, things went awry, and she ended up with those all too common "regrets"- and regrets often morph into FRA's [said the preacher to the choir]

Actually, given that so many cases arise from regrets, I suggest that Mr Bright's remark ought to be applied (or, at least, seriously considered) in most every "he said/she said", IMHO.

cos I know the US Law is a bit different.

In Criminal Court, is the test of guilt "Beyond reasonable doubt."?

If is what, how does "reasonable doubt" equate to (gambling) "odds", as it 20 to 1, or 1,000 to 1, or 1,000,000 to 1?

Given that in the USA the odds of

Odds of being an astronaut: 13,200,000 to 1

Odds of winning an Olympic medal: 662,000 to 1

Odds of an American speaking Cherokee: 15000 to 1

Odds of injury from shaving: 6,585 to 1

Odds of being struck by lightning: 576,000 to 1

Odds of being on plane with a drunken pilot: 117 to 1

Odds of dating a millionaire: 215 to 1

Clearly, none of these things are beyond reasonable doubt, as they all happen, quite a lot...

I am not debating the fact that there was enough evidence to prosocute. I am stating that this guy is the standard sports hero that has never been said no to and had is ass kissed his whole life.
This one is a preditor an an asshole. I may be a "moron" but at least I am not defending the obvious actions of a sexual preditor. Shame on anyone that would support his actions. Thank you for this website. I'm a female and a big supporter of men's rights. Women don't realize that when false claims of rape are made, it undermines real victims. Women also need to be more responsible when it comes to their sexual health. Perhaps it isn't a good idea to get drunk and go home with a guy. My brothers actually make women sign consent forms (no joke) before having sex with them because the false rape claims are getting out of hand. I believe if a woman has been found lying about rape or sexual assault she should get the book thrown at her. One of my best male friends was falsely accused of rape. Although he was found innocent, the situation messed him for life. The girl accused him of rape after they broke up. We went form a fun loving guy to bitter and depressed.

The fact that he si suing the DA who decided not to forward with the case, instead of meekly and gratefully crawling off with his name smeared, will have a salutary "chilling efect".

Accusations of rape were made against Stephen Milne in 2004. These were made extremely public at the time although no charges were ever laid. My grapevine - nephew in the same circle of mates - tells me it was consensual sex that the young woman thought meant a relationship. She stalked and harassed Milne for days after and eventually cried rape weeks later.

I have no personal liking for Milne but the abuse he cops from spectators and other players is an ongoing disgrace.

He will never be free of it.

This is just a little taste of what Ben Roethlisberger has in store in his future.

I found this site by accident by looking at an artical on Ben R on Google news. I also have 3 sons in their 20's that I would hate to be accused falsely. I know false accusations happen.I already said I agree with the DA on not enough evidance. Only Ben and this girl know.

However, just use some common sense and see that a 30 something guy took a drunk 20 yr into a scumy bar bathroom to have sex. Plus he is a high profile football star already in trouble with a lawsuit for sexual assualt. He puts a zillion dollar career in jepordy doing this shit? At minimum he is an idiot and a person that has very low morals. The Steelers and the NFL Office is going to go after him for his poor judgement on his actions

In closing I think that there are 3 types on this site.

1. Really good people that care about this issue

2. People that are bitter from a very bad experiance from the wrongful action of a woman.

3. The group of men that thinks there is no such thing as rape or sexual assault because all woman 5 to 85 "want it" "deserve it" or "lie about it" The true facts of rape of woman, men, and children is devestating. Where do you get the idea that he got her drunk. That she went bar-hoping would indicate that she has a fake ID, and has confidence that she can get into many bars. This would come from having used it to get into bars frequently. That would, in turn, seem to indicate that she was a frequent drinker (long before Ben came to town).

Yet, you seem to imagine that she has a better reputation. Based on what? Now you’re just justifying the ”idiot” label. From what we are told, it appears likely that no sex actually occurred. I suspect it was about to, but like with not just her enthusiastic consent, but likely at her initiation as well (she was the “winner” among the field of women vying for Ben’s attention, after all).

Sure Roethlisberger is a fairly pampered athlete, who no doubt has sex with women every where he goes. But, you know who’s to blame for that? The women who are willing to jump on the cocks of famous men, shoving their rivals aside to get their chance. The “playa’s” may be pigs for taking advantage of the female schmoregus board laid out before them, but it’s no crime to have sex with women who throw themselves at them. Blame the shameless and immoral women, first and foremost. If they didn’t “put out”, nay “throw out”; those men wouldn’t have the chance to be such pigs.

Look if you'd like to cut your teeth here arguing that what the police have determined was an FRA was, in fact, possibly actually a rape; at least try to do so on one that's more of a "close call".

I am a hard core conservative and libertarian. Obama is ruining our country. Bush was an asshole for getting us into Iraq. The whole damn country is not worth a drop of American blood or a dollar of Amerian money. So I am not some left wing nut or feminazi.

But I still believe men have a duty to respect themselves and treat women with respect and not take advantage of them wether they act like they "want it" or not. It is what separates us from the animals.

Anon at 9:02: I understand where you're coming from, but I think you are living in a past that may or may not have really ever existed. Young women today are as aggressive, or more so, than the young men. They are smart, and they aren't held back by much. Athletes have always had groupies surrounding them, and to paint this young woman as an innocent lamb led to slaughter, based on these facts, is unwarranted.

Let's start treating women with the respect they deserve -- they aren't helpless infants. They are free moral agents. Your comment insults two genders at once: it suggests males, especially male professional athletes, are predators, and it suggests that the women who willingly chase after them are helpless prey. It's all part of the same old pattern of treating men as sexual predators. Any male sexual misconduct falls somewhere on a sort of depravity continuum. Going to a strip club (the recent GOP scandal) is Rape-Lite. Adultery is a legal mini-rape, almost as depraved.

So, I guess what Tiger SHOULD have done before running around is what women do a lot more than men: irrevocably destroy his family unit by divorcing his wife. (The difference is, of course, when women divorce, they are generally the payees instead of the payors. Is it any wonder men don't initiate the divorces?) I'm not condoning what Tiger did, but it's a private matter. The only public matter was the apparent dv committed against him that no one seems to give a damn about. If the genders were reversed, and if his wife was chased, it would be one of the biggest stories of the year.

Exactly, what separates women from animals is that they are able to make informed choices, and must take responsibility for those choices, including getting drunk, flirting with and leading on Ben Roethlisberger, and going into a bathroom with him. None of this means she deserves to be sexually assaulted, and according to the DA, there's no evidence she was. So I'm not sure what your problem is.

Women in bars are not being tied down and having alcohol poured down their throats. They walk in voluntarily, usually with the intention of having a few alcoholic drinks. But you must know that.

Isn't it reasonable to believe that any woman in a bar is at least 20, since the bar-owner has so much to lose serving under-aged drinkers?

So where does your immediate suspicion of Ben R spring from?

I do think it is a shame that, I suspect due to political correctness, this young woman won't be charged with underage drinking. I suppose they don't want to "punish" her for coming forward with a rape charge, even thought that charge might have been false, given how politicized rape has become. That's exactly the wrong decision. If a young man her age were proven to be drunk, I would bet he'd be charged in a heartbeat. Moreover, not charging her is only perpetuating this hook-up/cry rape culture that is at the root of the false rape problem: the reality is, this non-incident likely would not have occurred if she wasn't in that unfortunate state where people, sadly, make stupid decisions. It is about time that we hold people, even young women who cry rape, accountable for the stupid decisions they make.

I would guess that he knows his job is to keep people away from Ben, not to go into the bathroom and be a voyeur. The door is usually the ONLY means of reliable access to a bathroom. So he was doing his job. Nothing more, nothing less. Doubtful that anything was pre-planned.

I am sure you are concerned about the safety of your daughter. But that has nothing to do with being Falsely Accused of a crime.

You can be at work at the time of the alleged crime and still spend time in jail and end up in a messy trial with your life ruined. You have NO control over what women will do when they are pissed off and want revenge.

Young women, and men for that matter, seem to feel 'entitled'. I believe we as parents are responsible for giving our children everything while not teaching them values, morals, and honesty that our parents taught us.
