Jail for Birkenhead woman who made false rape allegation

Julie Watts sentenced to jail for false rape allegation

A woman who made false rape allegations against her former partner has been jailed.

A judge told Julie Watts: "This can only be seen as a perverted act of revenge."

And he pointed out that such false allegations lead to jurors becoming "sceptical and disbelieving" when they try allegations of rape.

"Because, when they hear of people like you who make up these allegations on a whim, so genuine complainants will leave court disappointed because their assailant has been acquitted by sceptical jurors," said Judge Brian Lewis.

Liverpool Crown Court heard today that John McGuire was detained by police for a total of more than three hours after her lies.

"And for two months he was on tenterhooks worrying about the prospect of being wrongly convicted of these very grave offences and the possible consequences," said Judge Lewis.

He said he accepted that there had been some violence and intimidation in the couple's relationship.

"But that does not begin to justify any of this, particularly as by then your relationship was over."

Watts, 44, of Douglas Street, Birkenhead, pleaded guilty to attempting to pervert the course of justice and was jailed for eight months.

Damian Webb, prosecuting, said that on March 16 last year Watts went to the police and made the false allegations which she claimed spanned six years.

She falsely alleged that he had violently raped her, on occasions while armed with a knife.

A month later she made a retraction statement but it was not until May 23 that Mr McGuire was told that the CPS had decided not to proceed with the case.

Adrian Evans, defending, said that she had made her "foolhardy" decision to make the allegations because of poor thinking skills.

"She is deeply ashamed and embarrassed," he said.

By the way, I think your publishing of successful prosecutions against FRAs is an excellent thing.

Without ever seeing women being jailed for this crime, men could soon become resigned to the fact that women enjoy full immunity and too easily believe prosecutors who claim they don't have the legal power to prosecute offenders. This was intimated as the reason DA Kathleen Rice of Nassau county took no action against Damnel Ndonye in the recent Hofstra mass false rape accusation scandal.

It's vital that we men know that prosecutors do have powers to charge FRAs and that some of them are exercising that power. It's also vital that other prosecutors know that we know.

Given the "Mandatory" sentencing of FRAs here in the UK. (J Henriques, Oct 2009, Court of Appeal)

Given that the tariff is around two years imprisonment.

She got her sentence reduced by 16 months for retracting her statement in a month, after he was arrested.

There's your carrot and stick.

8 months (serve 4 with time off for good behaviour) jail and a lifetime jailbird record if you recant fairly quickly.

2 years or more if you don't

If you notice though it is almost always somewhere outside of the U.S. that false accusers are sentened to jail.

One of the only ones here in the United States that I have ever seen serve even a day in jail was the girl from new york that sent an innocent man to prison for 4 years!

And she will likely only serve a year....and of course she does not need to register as a sex offender.

Probably 99.99999999999999999% of all other false accusers get no jail time at all...most probably maker a nice profit from it.

It's just sick how in 2010 an injustice like this can still happen every day in this country right out in the open and nothing is done.

I think the U.S. may be alone in that judges, police chiefs and prosecutors are elected (correct if I'm wrong). In most of the rest of the world, these positions are appointed.

One of the downsides of such pervasive democracy is that American elected officers always have one eye on the next election - and I believe many prosecutors are deliberately not doing their jobs because to follow the letter of the law would be to lose their jobs. Prosecutors and judges in other countries can completely ignore personal popularity if they want to. If they prosecute unpopular law, any public backlash is more likely to be taken out on the legislation, not the individuals of the judiciary.
