Comment: Readers of this site know that the case described in the news account below this comment is incredibly typical. An innocent man was arrested after he was falsely accused of rape. He was detained and forced to undergo a full forensic examination (recently explained, in graphic detail, on this blog by a falsely accused ex-soldier). Imagine, if you can, the horror he experienced not knowing if the truth would be believed, not knowing if he might spend many years in prison. They young woman was found by friends crying, and they took her to the police where she lied that she was raped. In fact, the man had departed her apartment without having sex because he didn't feel comfortable with her drunken state. She will serve no jail time despite trying to destroy the man's life. The judge correctly noted that not only did she gravely harm the man, she also did a great disservice to actual rape victims. For every rape lie, the credibility of actual rape victims is reduced.

Teenage student who falsely cried rape 'has harmed real victims'
A UNIVERSITY student who falsely cried rape has been condemned for doing a disservice to genuine victims.
Karen Cassie, 19, claimed she had been attacked and forced to have sex following a drunken night out.
The man she accused went back to her flat after meeting in a nightclub and the pair started kissing but he left when he felt "uncomfortable" with the situation.
The fashion design student at Heriot Watt University in Galashiels, Selkirkshire, was later found by friends crying outside her accommodation and she told them she had been raped.
She repeated the allegation to the police but when discrepancies appeared in her story she later admitted she had not been raped and was "extremely remorseful".
Meanwhile, the man she accused of raping her was detained by police for several hours and subjected to a full forensic investigation.
Selkirk Sheriff Court heard that the student had written a letter of apology to the man in which she described him as a "decent guy" who "did not deserve this".
She wrote: "I cannot explain why I did it. I deeply regret it."
Sheriff Kevin Drummond said: "I am sure you understand you did a great disservice to every genuine rape victim. You also did a grave, grave wrong to a young man and wasted a considerable amount of police time. It is to your credit that you recognise all that.
"This is a charge which would justify imprisonment but, in all the circumstances, I am able to apply the alternative."
The teenager stood motionless as she was ordered to carry out 80 hours of community service.
Cassie, of Achinreir, Barcaldine near Oban, Argyll, pleaded guilty to a charge of wasting £538 worth of police time after making the false rape accusation at Galashiels Police Station on 18 October last year.
Mark Keane, prosecuting, explained how Cassie had been out drinking with friends on the evening of 17 October – ending up at a local nightclub. He said: "She was very drunk and at about 3am, she walked off with a man, and they got a taxi to her address."
Mr Keane said the pair "chatted, listened to music, and started kissing" but the man "felt uncomfortable" and arranged a lift home, leaving at about 3:45am.
When Cassie was not in her accommodation, friends began to look for her, and found her outside the building, sitting on the ground, upset, and crying.
Mr Keane said: "They asked her what was wrong and she said she had been raped."
Police attended and the taxi, which had taken the man home, was intercepted and he was detained before being subjected to a full forensic examination.
Cassie gave a statement at 7:30am, claiming the man had raped her.
Mr Keane went on: "He was interviewed and denied the allegation, and the accused was interviewed again regarding discrepancies, when she said her recollection was poor due to the amount of alcohol she had taken.
"She said she could not explain why she had said she had been raped."
Defence agent Greig McDonell said:
"She is no longer going out and getting drunk."

If the feminists who cannot bring themselves to condemn the actions of this woman, then they have shown themselves the hypocrites many of us have long believed them to be.
The likes of Marcella Chester and Denise Romano likely would just shrug their shoulders at this story, and declare, "Who cares? He's just a man, and at least she didn't get punished. No problem here." Never mind that it was the women who up-ended their cherished mantra of avoiding sex with drunk women to be on the safe side.
The specifics of what occur hear would seem to demand that they excoriate his woman's actions. But odds are they will offer forth not one iota of condemnation nor concern.

Even though they mentioned that "she did a grave wrong to a young man", the emphasis of the article again seems to be how her false accusation harms potential rape victims. It annoys me. No, the most important part of this story is the young man, he's the one who has received the most damage.
The humiliating examination, the possible harm of his reputation, and the terror he probably felt that night. This man was a victim of a terrible crime, I'm not worried about abstract potential rape victims right now.

When someone gets convicted of rape do the headlines read that he has done the falsely accused great harm?
And when a guy does get convicted of rape and it ALWAYS is a prison sentence. Does the judge say how this was a horrible crime because now guys that were falsely accused will be believed less??

If you forced a girl into a room and stripped her naked and invaded her private areas you would serve decades in prison and be on a sex offender registry for life.
That is exactly what she did to this guy.
She does not even get one day in jail.

apart from the penal aspects (no jail), what about the civil law punishment? Will this feminist have to pay something to her victim? Like £10,000?
In case anybody didn't already realize this, here is a cardinal rule for dealing with false rape accusers: never take them at their word when they apologize.
False rape accusers are generally people who have been lying and apologizing for having been caught lying throughout their lives. The apology is just another aspect of the manipulation.

I have known false accusers through out my life....not of rape but of other things.
I had two for neighbors and I lived in fear of being accused of something for years. This is probably why I have an interest in this great site.

Quite frankly, all this type of thing proves is that it doesn't really matter if you rape or not. You're liable to be accused of it either way.

A friend of mine is currently supporting someone who says she was raped. He told me cos he needed help with what to do. A couple of weeks ago, he told me how upset she was cos the guy who supposedly raped her had been released due to lack of evidence, and how scared she was cos he went to her uni and she'd have to see him almost every day. She admitted she didn't remember saying no or resisting at the time, but she says it was rape because she was drunk so not capable of giving consent, (so she clearly knows some part of the law about this and is able to use it for her purposes).
Then a few days ago, my friend told me how outraged he was that the girl's been charged with perverting the course of justice. He wanted to support her and he just couldn't see what was going on. It turns out the accused was a friend of one of her flatmates so he was at their place one night, and they were all drinking and laughing together. All the flatmates were questioned and said that she took him up to her room. They were all taking photos of each other on their phones while they were having a good time, and some of the photos show her and this guy kissing, (she claims she's a lesbian, by the way). Also, my friend told me the girl's mother came to bail her out but that she seemed to think the police were right, which makes me think maybe she has a history of being less than truthful, plus the fact she told my friend how difficult it is for her cos she's been raped before and the guy was released on that occasion. Was she really raped before, or was it another case like this, where she had sex with a guy, woke up next morning sober and regretted it, and cried "rape"? I really hope she gets the maximum sentence cos this can't be allowed to go on. My friend will be upset but he needs to realise what people can be like.
And let's not forget that it isn't just women who do this. The law has been stacked against men for a long time. Until only a few years ago in the UK, rape was legally defined as a crime against a woman. A man could be bound, gagged, have his clothes riped off, and penetrated against his will, and the perpetrator could not be charged with rape cos the victim was a man. He could be charged for other things, such as assault, but not rape.
Still, nearly all public discussion of rape talks about it as something done to women, which makes it even more difficult for raped men to come forward. We need to change that culture.
The sad thing is that, now that the law has changed, men are just as capable of making false rape claims as any woman. I supported a friend last year after his "rape". I was really cut up about it cos I really cared for him. It's only when a few of his friends were talking about it months later that we realised we'd all been told completely different stories - not just a few minor facts, but these were detailed, elaborate stories, which were completely different. In one story, the perp was a stranger and there was a police investigation tied in with other similar reports in the area - yet nobody remembers any news reports about any series of rapes. In another version, he never went to the police but he named the person who supposedly did it - so no charges but still a guy's reputation at stake cos there are rumours about him, and cos there's no police involvement, he has no opportunity to clear his name unless he brings charges of slander. The city where it happened also changed from story to story - one was his home city and the other was where he went to uni. He said he went to the GUM clinic for a health check-up afterwards but a number of us counsel people who have HIV scares after unprotected sex with strangers, or have been to the clinic with friends who have had health scares, so we know what happens with the various samples they take. What my friend described was completely wrong. It sounded like the sort of detail someone might add if he were trying to make a story sound credible but didn't actually have the experience to back up the description he was giving.
He never admitted to the lies when he was confronted. Instead, he just doesn't talk to us anymore, and we've been demonised by his other friends for not supporting him - I don't know what he's told them but they obviously can't see what has happened. The one thing common to all the different stories is that his uni was really supportive when he told them about the rape, and they let him repeat the year because his performance was affected by the trauma of it. He made a big deal of that in the story he told me. We think maybe he was failing anyway, and that is why he made up the story.
All of this means that I'm now a bit skeptical, which is horrible because any one of us could be raped and I can't imagine having gone through that only for people to doubt my story, but when you see people pull stunts like these, how can anybody help being guarded with how trusting they are? Something needs to be done, both for the sake of genuine victims and for the sake of innocent men who are falsely accused. We need tough sentences for people who lie in this way, and who casually destroy a man's reputation, and who think nothing of robbing him of his employment, relationships, and freedom.

What circumstances would those be, oh judge? What possible mitigating factors does the defendant have, other than two X chromosomes?
What's with the weird phrasing? Most people would say "I must apply" or "I should apply". "I am able to apply" sounds like what somebody looking for any excuse to be lenient would use.

It is difficult for people to live with the problem that they lied and can be scared for the damage they done and that something doesn't happen back because he knows the truth.I mean what could her friends and family think of her.Or his friends and family say to her.It's normal to fear the consequnces of how you are treated after you lied.
yet that fear and pain is needed when you lie,to learn your wrong doing and should't do it again.But if you can't fix yourself then more punishment avaits until you learn what is right.

The way I see it there are way more false accusation than actual rapes.
I grew up with girls that I had as friends that slept around like it was there job and I heard zero complaints from them.
Also in my entire life I have only known 1 girl that said she was raped and it was one of those drunken slept with a guy and regretted it stories.

Oh, rape really is a terrible thing; and it certainly does matter "whether you rape or not." But the problem of false accusations is one of the worst that America faces.
I wouldn't say that there are more false accusations than true ones, but false accusations occur with disturbing regularity, and are enabled by unscrupulous individuals who use the legal system to promote themselves.

It is grossly insensitive when judges fail to make clear that the victims of this crime are the falsely accused. I've written entire pieces on this issue.
More and more, however, I have come to understand that false reporting, more than any other crime, subverts the justice system in a way that goes beyond the immediate victims.
We've always known that we're supposed to take rape seriously (remember the story we did on Teddy Roosevelt's State of the Union Address where he declared that rape is worse than murder?), but when women lie about rape and victimize innocent men and boys -- and those lies are difficult to expose given the nature of the alleged crime -- we lose faith in our ability to do justice. We lose faith in our ability to know what is true and what is false. The result is, we don't do justice very well, for anybody. We don't want to convict innocent men. Jurors know that women lie about rape. It's no secret. Older women are especially harsh on rape accusers. Jurors are generally (NOT always) good at not convicting where there is reasonable doubt. There are some notable and horrific exceptions to this. (The far more prevalent problem for falsely accused men and boys is that they are arrested, charged and held too readily, and enter into too many plea bargains to avoid even the chance of lengthy incarceration.)
But I have come to realize through hearing from actual rape victims who (surprise, surprise!) SUPPORT this web site, that actual rape victims loathe and detest these rape liars because they make it more and more difficult to separate the good guys from the rapists.
Please understand that none of these rape victims I hear from want to see innocent men jailed for crimes they didn't commit. That might surprise some, and I am sure there are exceptions. This attitude is in contrast to the callous rape feminists who haunt the blogosphere, and who are still wagging their thick tongues with disgust that the lacrosse boys didn't go to jail. The actual rape victims have a valid point: the crime of rape is difficult enough to prove without having the integrity of every rape accuser tarnished by the actions of the rape liars. What a world we would have if women only cried rape when it happened.
The solution? Well, it's one that the folks who dominate the public discouse about rape don't want to hear: deter false rape claims, of course -- deter them with the same severity we deter other serious criminals. Charge them, bring them to trial, and sentence them to the same term the falsely accused male might have received. You want to help raise the integrity of rape victims? Then you need to start making examples of some of these girls who are caught on video lying about rape. Not community service. For every other serious crime, we believe in deterrence. So should it be here.
But the rape feminists, as opposed to actual rape victims that we hear from, would rather stick their heads in the sand and insist false rape claims are not a problem. And that, my friends, is flat-out stupid because everyone KNOWS they are a problem. We will keep telling the world they ARE a problem -- because innocent men and boys are not collateral damage in some "more important" war on rape. Their victimization needs to be taken every bit as serious as the victimization of actual rape victims.

It seems her motive was revenge for rejection, which is one of the three main reasons found by the Kanin study:
"The study of these 45 cases of false rape allegations inexorably led to the conclusion that these false charges were able to serve three major functions for the complainants: providing an alibi, a means of gaining revenge, and a platform for seeking attention/sympathy. This tripartite model resulted from the complainants' own verbalizations during recantation and does not constitute conjecture...

Essentially, this category involved a false rape report as a means of retaliating against a rejecting male. Twenty-seven percent (n = 12) of the cases clearly seemed to serve this function. These rejections, however, ranged from the very evident cases of women who were sexually and emotionally involved with a reciprocating male to those women who saw themselves spurned from what was in reality the females' unilateral involvement. Regardless, these women responded with a false rape charge to perceived rejections."

There is nothing to be gained by advocating a solution for a non-existent problem, as there is no evidence to support such an alliance. According to Kanin, feminists and police were adversaries on this issue:

In this case it seems law enforcement did their job to protect the innocent, but the court was too lenient in sentencing the false accuser. While I don't know much about British law, if the problem is the law itself, the the solution would be to change the law. Having law enforcement arbitrarily ignore the law is nothing less than corruption, which would create even worse problems.

My sympathies - those places inside me not yet fully obliterated by rape-feminists - are with rape victims as well as with the falsely accused.
It's a natural alliance, really.
Revenge seems to be a plausible motive, but it might also have an attempt to garner sympathy from her girlfriends as to why she went home with the guy in the first place. Maybe she didn't want to be stigmatized because she believed her girlfriends thought he was "unworthy" or her.
But, as written, we really don't know any of that. Some women make false rape claims for no reason whatsoever -- just to get attention. It is sick almost beyond words when those women identify a specific male.

I don't find that exceptional or unreasonable or anything else.
As an FRA victim, I have no interest in some random woman, who may or may not have run a red light, incarcerated for several years.
I (and the rest of society) do not need protecting from random women.
We need protecting from sick and evil women who make FRAs, specifically the individual women who made the specific accusation against us.
I do not see anything peculiar in any other victim of any other crime, actual rape included, feeling any differently.

FRAs are the only crime where you get to learn everything about the criminals' hardships but rarely about the actual victim.

It's interesting 'older men' don't weigh in so much.
It would be revealing to hear their thoughts.
In defense of younger women - sometimes they cannot see the forest for the trees. They are in the thick of it - whether they have experienced an overly agressive male, or have been cautioned about rapists so much they see them behind every tree.
Older women aren't out there making foolish mistakes. They aren't getting drunk in frat houses at 2:00 or learning their limits with drugs and alcohol.
I've read mothers posting about their son's false rape accusations, but no fathers.
Older men, or Fathers of young women, who have been through youthful foibles might have a less harsh perspective.
