It is not at all astounding that we live in a time when men and boys are at greater risk than ever of being falsely accused and wrongly charged and convicted of rape. It is astounding that more people didn't see this time coming. The fact is, we've been planting the seeds for this day for decades. We've carefully cultivated, watered, and fertilized the soil from which it sprang. And now we are shocked to see the fruits of our labors in full bloom. How did this happen?
Rape Reforms
Professor Alan Dershowtz once made the seemingly innocuous statement that "the rules of evidence have been changed to make it easier to convict defendants of rape and harder to cross-examine alleged rape victims."
Dershowitz was right, of course, but he was attacked for saying it.
Dershowitz was referring to the rape reforms of the feminist revolution in the 70s and 80s. Those reforms led to rape shield laws that forbid inquiring into the accuser's sexual past with persons other than the defendant; the law that eliminated the requirement of corroboration; the laws that eliminated the requirements of force and resistance; and the law that made nonconsensual sex during marriage rape.
It would be dishonest in the extreme to refuse to acknowledge that these laws made it easier, and in truth, much easier, to obtain a conviction in a rape trial. Yet, Dershowitz was criticized for supposedly failing to appreciate that the laws reforming rape were designed to do nothing more than treat rape like other crimes.
The problem with that noble-sounding sentiment is that rape isn't like other crimes. The very physical act that constitutes rape is typically precisely the same physical act that constitutes the most natural and fundamental demonstration of love and bonding known to man -- an act that has been performed somewhere, in every land, among every people, every second of every day since the beginning of time. It is simplicity itself for women to transmogrify garden variety consensual intercourse into rape with nothing more than an after-the-fact declaration of non-consent.
Yet, advocates of rape reform point out that in pre-reform days, rape law was alone in requiring a prosecutor to provide corroboration for a victim's testimony. For example, a robber could be convicted on the victim's testimony alone; a rapist couldn't.
The crucial difference lies in the fact that the physical act of robbery doesn't also happen to be the same physical act that constitutes a fundamental and necessary act of human existence. It is, thus, naive to think that rape ever could, or should, be treated like other crimes. And that wasn't really the goal of rape reform advocates anyway. Their goal was to jack up rape convictions, and they have advocated numerous laws and policies to insure that rape isn't treated like other crimes -- that rape accusers are afforded special treatment not afforded any other criminal accuser. Many of these changes have been adopted, and here are a few:
▲Unlike any other criminal trial, a rape trial in federal court and in various state courts allows evidence of the defendant's commission of prior sexual assaults in order to show his propensity for committing the crime at issue. Under this rule, which is unique in all of American jurisprudence and condemned by many legal scholars, the jury is to be informed of the defendant's prior sexual assault even if the defendant was acquitted of it, so long as it is proven by just a preponderance of the evidence (far lower than beyond a reasonable doubt).
▲The UK compenstates victims of even non-forcible rape, and "over the clothing" sex acts, no matter how slight their injuries, but traditionally has refused to compensate men falsely accused of rape, no matter how egregious their harm. Last year, a court ruled that one falsely accused man (who has written to us -- I'll be writing about him next week), is entitled to compensation, but the UK is appealing that ruling.
▲Various U.S. states are extending and even abolishing statutes of limitations for rape; in contrast, false reports are often subject to a limited statute of limitations that will bar most claims if the woman's lie has its intended effect and her fraud is not discovered for several years.
▲Using polygraphs to test the credibility of rape claimants is verboten. To be eligible for VAWA funds, states and territories must certify that they prohibit polygraph testing of victims. VAWA provides: "No law enforcement officer, prosecuting officer, or other government official shall ask or require an adult, youth, or child victim of an alleged sex offense ... to submit to a polygraph examination or other truth telling device." In contrast, using polygraphs on men accused of rape is routine.
▲Rape accusers retain lifelong anonymity, either by law (UK) or by agreement of news sources (U.S.). In contrast, the mere allegation of rape, without any other evidence and no matter how far-fetched, invites a man's name to be splashed all over the newspaper, TV, radio, and Internet for the world to titillate at the details of his humiliation.
▲Many colleges have adopted policies not to punish underage drinking if it is discovered in connection with a sexual assault complaint. This rule does not apply to any other criminal complaint.
▲Rape accusers are afforded all manner of counseling and assistance funded by tax and tuition dollars. No similar assistance is afforded to victims of other crimes, least of all false rape claims.
And these are the milder reforms. Some feminist scholars want to reverse the presumption of consent for intercourse when a woman cries rape so that the burden is shifted to the male to prove consent. This would officially transform intercourse into a presumed crime whenever a woman says it was rape. And recently, the U.K. toyed with targets (quotas) for rape convictions.
Have these reforms made it easier to cry rape, charge for rape, and convict for rape? The question scarcely survives its statement. But they have also, by necessity, made it easier to falsely cry rape, and to wrongly charge and convict for rape.
No Reforms For The Presumed Innocent
While these reforms have been occurring, have there been any reforms to protect the presumed innocent who, too often, turn out to have been falsely accused?
Has any state increased the maximum or minimum sentence under its false reporting statute for rape claims?
Has any major news outlet withheld the names of men accused of rape until conviction?
In fact, while the rape reforms were being enacted, the only attention paid to the falsely accused has been to pretend they don't exist.
We have handed women and girls unprecedented power not only to bring their rapists to justice, but to destroy the lives of innocent males merely by crying rape. But we didn't bother to consider what we should do if they abuse that power. Every day, we see evidence that too many are abusing that power, but we are content to keep our heads in the sand because we've decided that the victimization of our daughters is more worthy of our protection than the victimization of our sons.
The result is that innocent men and boys are at greater risk than ever of being falsely accused, and wrongly charged and convicted, of rape. And that is a fact that should be intolerable to all civilized people.

Woman who set up rape scenes convicted

Followed by:

So, we know this as the case we had previously learn of in which a man, by mere happenstance of being involved in a accident with the liar, came to be targeted via an FRA.
Also we see that she is NAMED. [I suspect that this is something which can only happen in the UK after they are convicted – otherwise, their names are forever sealed? AoFR, might you shed some light here? In the next story, we are specifically informed that an accuser cannot be named, by law.]
While the innocent man was detained for 20 hours, the Police never-the-less did conduct a proper operation, and even set up surveillance of HER

Score on for both technology used to protect men from false charges, as well as for proper Police work. [Yes, they did hold him for 20 hours, but, in their defense, the woman did specifically name him, and the Police would have to act on that information until such time as they could determine that there was some doubt to her story. In other circumstances, where the work was not expedited, this might well have taken days, if not weeks. So, all-in-all, I feel the Police deserve a hat-tip on this one.]
Also score one for both her being named, and for her being convicted. We’ll have to wait and hope that she gets an appropriately stiff sentence.
The minuses from this story are, first, that an innocent man was detained for 20 hours. That cannot have been pleasant (although, it’s not clear if he was publicly named or not). And, secondly, that the Judge noted both the waste of time and resources as well as the harm to other potential victims, but neglected to note the harm potentially done to the innocent man.

Woman lied over rape claims against 'mystery stalker'
In this account, we again find that the Police did their job properly, investigated the claims fully, and, when they came to doubt her, they (once again) set up surveillance of HER.
”Police began to doubt her and launched a covert surveillance operation that the prosecution said proved she was making up the attacks.”
Her lies were uncovered, and she’s been convicted (and is awaiting sentence).
So far, so good.
But, then the article takes a dire, and entirely unnecessary turn. It seems to completely forget that the woman had been lying all along, and that there had been NO RAPE, ever, at all; and takes up the cause of an anti-rape group (who, in this instance, come off more as a pro-FRA group).
”The campaign group Women Against Rape has criticised the police and the Crown Prosecution Service for bringing the case, claiming the police launched the investigation having made mistakes when they looked into her claims that she was the victim of a stalker.
The group said it was "alarmed" at the number of women being prosecuted for false allegations of rape.
WTF!?!?
First, what mistakes did the Police make in their investigation – other than believing the women in the first place? They had done a through investigation. They give a full explanation as to why they decided to investigate her. (see below) What is the complaint to be made against them?
Maybe it’s that “other thing” – their alarm at women being prosecuted for FRA’s. What exactly would they propose – a reverse quota, allowing only a small percentage of FRA’s to be prosecuted (in contrast to calls for rape conviction quotas for men accused – regardless of actual guilt or innocence)?
This seems utterly absurd. What can possibly be wrong with punishing those who are known to have committed crimes?
In defending FRA’s this Women Against Rape appears to have completely “shot” any credibility that they may have enjoyed in their effort to help real rape victims. It’s as if they also wish to seek “justice” on behalf of un-victimized women, against innocent men. That’s just pure misandry in my book. How can they claim that this is anything other than contempt and hatred for men?
”Outside court Detective Chief Inspector Paul Shorrock, the senior investigating officer, said the police and CPS had considered very carefully before investigating Sherwood. They had ploughed many resources into hunting the supposed rapist before concluding he did not exist. He said one reason why they felt it necessary to pursue Sherwood was to reassure other people living nearby that there was no stalker on the loose.”
The net pluses I see coming from this story are, first, that no innocent men were arrested, named, nor harmed. Then, once again that she was named (I was incorrect in my last post that this was the story wherein we are informed that, by law, a known – but yet unconvinced – false accuser cannot be named), that she was investigated, that she was charged, and that she was convicted.
And again, we can score one for technology being used to protect men.
Woman admits making false Viking Bay rape claim
It is in this story that we are informed that the law precludes the known (but unconvinced) false accuser being named. [insert rant about the complete lack of such concern and deference for those men who are accused – even falsely]
”The 42-year-old from Ramsgate, who cannot be named for legal reasons, told police she was assaulted at Viking Bay…”
Once again, the Police had to act on her claims, and they did so in proper fashion, doing a through investigation, which included interviewing possible witnesses, and reaching the appropriate conclusion that the unnamed women was simply lying.
But, not before arresting two innocent men – who were unfortunate enough to match the description she fabricated for Police. Hopefully, they were neither named, nor held long.
”Her allegations led to an extensive investigation by officers from the major crime department at Kent Police, who arrested two men as a result of descriptions provided by the woman.
However, several witnesses who had been on the beach at the time of the alleged incident gave statements to police, contradicting the woman's account of events. ”
She was given what is known as a formal caution, which prompted one commenter (Janet) to remark:
”Why was this woman only let off with a caution? She cost us, the taxpayers, £40,000, as well as untold trauma to the two men accused, and their families.”
As to why a caution, perhaps AoFR can explain – because I sure as Hell cannot.
Hopefully, there are plans to go further, charging and prosecuting her, as well as an effort to recover (some of) the £40,000 in costs. (seeing a woman having to actually pay-off the cost she caused would likely serve as a very good deterrent to other women, IMHO.)
WRT those two innocent men arrested, I’d like to both take note of, and exception to, these statements from Det Insp Lee Whitehead:
”We'd like to reassure the community that all allegations of this nature are treated seriously and thoroughly investigated. Victims of such crimes are always treated with great discretion and sensitivity.” & "Any allegations proved to be false are also treated seriously and dealt with accordingly. False allegations undermine genuine victims of sexual assault and divert police resources away from what we should be concentrating on."
First, when he speaks of ”such crimes”, is he referring to the non-rape, or to the FRA which resulted in two arrests, and are the ”victims” the un-assaulted women, or the men who were arrested?
And, is that ” discretion and sensitivity” afford to the innocent men, or just to the unnamed liar?
Lastly, yes, genuine victims may be harmed, but, clearly, so are innocent men who find themselves being arrested. Would it kill these spokespersons to at least mention it?
And, I’d really like to know more about this legal prohibition against her being named, even though she is known to have lied. As the lead article of this thread notes, ”Rape accusers retain lifelong anonymity, either by law (UK) or by agreement of news sources (U.S.)”, yet, after they are convicted, we do see women in the UK being named for their FRA’s. Again, I find myself of the belief that anonymity extends only until the time of conviction. [the further assumption being that, if she were to be acquitted, the legal enforced anonymity would continue. Oh, that only innocent men could enjoy the same!]
To the best of my knowledge, there is no presumption of anonymity for anyone in UK Law, with the exception of those scenarios that are specifically defined, eg
Cases involving minors.

Jail for Birkenhead woman who made false rape allegation
”A woman who made false rape allegations against her former partner has been jailed.
A judge told Julie Watts: "This can only be seen as a perverted act of revenge."
Of course it was all about revenge. We see it way, way, way too often. And, all too often, even when the targeted men are cleared, and the lies exposed; the women still get their “revenge” via the damage done to the accused man.
”Liverpool Crown Court heard today that John McGuire was detained by police for a total of more than three hours after her lies.
"And for two months he was on tenterhooks worrying about the prospect of being wrongly convicted of these very grave offences and the possible consequences," said Judge Lewis.”
Yes, but the judge neglected to mention the probable harm to Mr. McGuire, seeing as how he has been named, and will thus be known as an accused rapist (by many; including, but not limited to, potential employers). How does this important consideration continue to be overlooked so often? Especially given that the potential harm to real victims is so often noted.
”And he pointed out that such false allegations lead to jurors becoming "sceptical and disbelieving" when they try allegations of rape.

True. But, again, what of the man already victimized via the FRA? Is his long-term injustice not worth considering, while a hypothetical rape victim seeing her attacker be (again, hypothetically) exonerated, is? Hum?? Let’s see: existing victim vs. hypothetical victim? Only misandry can explain why the existing male victim can be ignored, while a not yet-existent female one must be fully considered.
I was convicted (plea bargained actually) on a false rape claim.
I am a registered sex offender until some time in Oct. of 2011 when I can move to a different state and apply to get off the list.
Funny thing is, despite the fact that the girl and I went to eat afterwords, at a sit down restaurant, it still didn't click in to the police that something may be awry. I was the male and the male is always guilty until proven innocent.
The polygraph test I did was bullshit too. As has been said above, they have been debunked. In my case, I told the exact truth, but was so stressed out from the entire thing that the polygraph came back saying negative. I later found out, in jail, that to pass one you need to get yourself drugged up on Valium or some other relaxant. So, yes, polygraphs are total bull that shouldn't be used, ever, on anybody. They should be banned entirely. They only measure how uncomfortable you are with talking about a topic, not if you're lying or not.
I really find a lot more hope in reading your articles. It seems like I'm not the only one in the world who has been, in itself, raped of my honor (or however you would call it). The bad thing is, because I'm male, nobody cares to even see it that way. Most people, especially women, see it as "registered sex offender, EWW EWW EWW EWW". *sigh*

I think polygraphs are popular because police think they prompt confessions. I agree with you: if it ain't admissible in a court of law, why in the hell do police rely on them in deciding to hold the presumed innocent in jail? Something awfully wrong with that logic.
And your false accuser sounds like she was really upset about the ordeal. She probably allowed you to pick up the check, too.
This registered sex offender nonsense is just another ploy or rape feminists, in conjunction with their useful idiots, the chivalrous law and order males, to shame males. YES, a guy who rapes a child should be punished severely. But plea bargains for some diluted form of "acquaintance" rape? My, oh, my!

Now that I've possibly derailed the thread, let me get back to the main topic:

In the earlier thread concerning the "blame FRA's on male oppresion" story from 1973, I made this remark:
"Today, we understand the R-bomb as a very, very useful get-out-of-anything card for women to play. Given the enhanced focus society now gives to the crime of rape, the self-serving and malicious use of FRA's can even be seen as having been predictable. Now, FRA's actually make a lot of sense - twisted and evil sense, but sense none-the-less."
Despite one anonymous commentors dissenting opinion, society HAS come to place far greater emphasis on the crime of rape. While family members and friends have always cared greatly for the plight of (their) women (and, this has often been extenuated along racial/ethnic lines), the fact had long been that at the first-responder level (Police officers), unless a woman had also been abducted and brutalized, simply crying rape would not have carried the same effect as today. A woman’s family may have been ready to go out for blood, but, by-n-large, incidents of he said/she said (i.e. “date rape”) just wouldn’t have evoked much in the way of sympathies from those outside of a woman’s “circle”.
Now, not only are people, in general, much more aware of the psychological trauma to rape victims (some even understand that men suffer as well), but so is Law Enforcement.
There are now rape crisis counselors available to (female) victims through law enforcement offices (and public tax dollars). And, every cop, from rookie to chief, is (made) fully aware the fate they may suffer if they fail to treat an alleging victim with proper care and respect or if they fail to take the proper (police based) actions based on her complaint.
And, as we here know all too well, this same “approach” is applied even in those he said/she said instances. The guy whose done no intentional wrong will often be treated the same way as would a brutal kidnapping and beating rapist.
The social view of the “rapist” may have changed little since 1973, but the understanding and compassion for the “victim” has skyrocketed.
What this means, in the end, is that now, not only will a woman’s cry of rape engender murderous rage in her male friends/family, she will also get the full belief and attention of law enforcement, and copious help and support as well. This is a great thing for real victims – and a potential bonanza for the false accuser.
In the end, it’s little wonder that so many seem to so flippantly throw out the false R-bomb. The better question might well be is, “why don’t more women do so?” It’s certainly not for lack of efforts on the part of FRA-apologist groups (posing as victims rights advocates). IMHO, it speaks volumes about the “quality” of those women who would not resort to making FRA’s. So little to lose, so much to gain – yet they still manage to refrain.
It is a perversion of the now culturally dominant "gender feminist" community, that has lead to the perversion of our legal system that now enables false rape accusations.
It is mostly college age guys that are at most risk of false rape accussations. Alot of colleges are now culturally dominated by the gender / Raunch community who use Rape hysteria as a pretext to attack hetero-sexuals.

That is true, but actual rape has always been taken seriously. Most of
emphasis on rape is on events or mental abstractions that are not rape, such as "date rape", "rape culture", etc.
I think the idea behind the initial rape shield laws were valid. The laws were intended to extend to female victims the same presumptions extended to the accused, in terms of past sex acts, behavior, state of dress, etc. Just because a person committed a similar crime before does not mean the person committed this crime. Likewise, just because a person agreed to a sex act before does not mean the person agreed to this sex act. That is what the laws were designed to protect against.
The problem is those protections are not enough for feminists because it is still difficult to prove rape when there is no evidence other than a person's word that it occurred. For feminists, it is not that women are not believed, but that feminists do not believe women ever lie about rape or that men or boys are ever falsely wrongfully convicted.

You are far too charitable.
As for the misandrists in government and academia, they know full well that men and boys are routinely wrongfully convicted. At best, they are utterly indifferent. More likely, however, is that they want this to be happening, and support it. Their aim is to imprison as many men as possible and boost women's status.
This is from an old FRS post:
Perhaps the principal reason innocent men accused of rape are not viewed as "victims" in the same sense that, for example, women who really were raped are viewed as "victims" is because of purported past injustices to women. Innocent white men, especially, are not viewed as a class deserving of sympathy or special protection, and when a false rape claim destroys the life of an innocent white man -- let us be honest -- some members on the extreme left react with glee and view it as a sort of twisted payback, or at the very least, necessary collateral damage to right perceived wrongs.
Two heinous examples of this:
From Newsweek, May 1, 2006, in a story about the alleged rape of a black woman (her name is Crystal Gail Mangum -- even though some newspapers still refuse to print it) by three Duke lacrosse players, the following appears:
"Across town, at NCCU [North Carolina Central University], the mostly black college where the alleged victim is enrolled, students seemed bitterly resigned to the players' beating the rap. . . . Chan Hall, 22, said . . . he wanted to see the Duke students prosecuted "whether it happened or not. It would be justice for things that happened in the past."
(Emphasis added.)
You see, for people like Mr. Hall, unfair stereotyping is only wrong when it's directed at people who happen to look like him.
It is no exaggeration to assert that when the three young lacrosse players were declared "innocent" (not just "not guilty") by the state's attorney general, many extreme members of the blogosphere -- advocates of both African Americans' and women's rights -- were not happy. It is not a stretch to assume they would have been happier if, in fact, Crystal Gail Mangum had actually been raped. Think about that last sentence. They would have preferred that Ms. Mangum was actually raped so that the accused white "boys" could be prosecuted. And that might be the single most twisted point about the entire tragic Duke lacrosse affair.
But Mr. Chan Hall, quoted above, had better be careful: there are loonies galore on the far left who would have no hesitation about wanting to see him convicted as a rapist, innocent or not -- not because he's black (presumably) but because he's male.
To some radical feminists, it wouldn't matter if the falsely accused male is white or black -- all that matters is that he's male, and, thus, payback is appropriate. On one radical feminist blog, the hostess proposed to make all heterosexual sex criminal if the woman decided, even retroactively, that it was rape. Of course it was all about revenge. We see it way, way, way too often. And, all too often, even when the targeted men are cleared, and the lies exposed; the women still get their “revenge” via the damage done to the accused man.
We should understand that to many vengeful women the legal punishment is not the goal. It is rather the character assassination and the consequent social ostracisation of the targeted individual that is the desired end.

I'm a guy and I don;t know about other guys on here but I have had to literally pull girls off of me at parties and other times. But that sort of stuff is never mentioned about how sexually aggressive females can be.

I don't believe that false rape accusers should be put to death -- not that they are anything less than the worst criminals on the planet.
But false rape accusers should face exactly the same sentence and stigmatization that their victims face. The penalty for lying under oath about a rape should be the same 20 years to life (or whatever) that the victim faced.
And false rape accusers should be listed on the same sex offender database that the victim would have been listed on upon being falsely convicted.

Another one to consider is how CNN handled the Duke Lacrosse case. They spent a solid year making those 3 innocent guys out to be rapists posting their names and photos all over CNN and HLN.

I don't understand why there isn't at least some questioning of these men going on, I don't want to say to blame the victim (the men accused of false rape) but if you know that this type of thing is happening why frequent bars and try to pick up these women? Why get married in the current climate? It just doesn't seem intelligent, and other sites talk about MGTOW and foreign women.
A lot of these men ignored obvious red flags and pushed hard to date these women. For the Duke Lacrosse case obviously this isn't true, but for the vast majority of these cases there has been contact and it's an actual relationship, or at least to the point that it was at one point consensual sex before she decided to recant that. If men as a whole just would withdraw from women for even a small amount of time in protest these laws might get changed. But as men are seemingly as a whole incapable of understanding the biases of the legal system, and are as a whole generally incapable of avoiding women, it's like just shooting fish in a barrel for feminists.
