The woman in the news story below waited four years to level the accusation. We've written much on this site about how the passage of time can destroy one's ability to defend a rape claim. For example, evidence that would have established an alibi (e.g., receipts, email messages, and even witnesses) are usually long gone, and whatever alibi existed is usually long forgotten. How is it really possible to defend against an accusation after that amount of time? Officer Maloney is one lucky individual.
Officer acquitted in sexual assault case
HINSDALE— A Hinsdale police officer has been cleared of charges that he sexually assaulted a woman while investigating a complaint about animals in her neighborhood.
Officer W. Rodney Maloney, a part-time officer and animal control officer for the town, was acquitted of indecent assault and battery last week by a six-member jury in Central Berkshire District Court after 10 minutes of deliberations.
Maloney tells The Berkshire Eagle that although he feels vindicated, he’s still upset that someone brought false allegations against him in May 2008 that caused him "a year and a half of hell."
The 51-year-old woman who made the accusation claimed Maloney assaulted her in June 2004 during an unrelated call, but didn’t come forward because she thought no one would believe her.
Thanks to one of our readers for the tip.

You said it yourself -- Maloney's lawyer got him off, so why ask "How is it really possible..."? Most cases after that length of time do not result in a conviction even if a guy is guilty.
Do defense attorneys sleep well at night when they know their client is guilty?

Do you think prosecutors sleep well at night when they know many of the people they gained convictions against are innocent, while the " victim " is the real criminal?

Your comment evinces an absence of regard for the falsely accused. Do you seriously think that a claim made four years after the alleged act will be anywhere near as easy for an innocent man to defend as one made shortly thereafter? Every trial attorney -- every single one -- knows the answer to that. Do you dispute what we've said about evidence being lost?
Your final question, I suppose, is meant to put us in our place. But sorry, it's not pertinent to our site. We are concerned about innocent persons, not rapists.
Kindly go haunt one of the morally grotesque sites that pretends false rape claims are a myth.
