It's not often that you see an underage person being prosecuted for a false allegation. Of course, she isn't named, but all the men in the case are.
16 year old to be prosecuted for false allegation.
NEW DELHI: A trial court has ordered prosecution of a 16-year-old girl for allegedly turning hostile and making a false statement against four men accusing them of attempting to commit rape and causing hurt to her. While acquitting the four accused, additional session judge Nivedita Anil Sharma said, "It appears to be a clear case of perjury. I deem it proper and appropriate to prosecute the prosecutrix (victim) for the criminal offence of perjury in the interest of justice.''
The girl had alleged that one Simranjit Kaur offered her stupefied cold drinks and the other three attempted to rape her.
She had made these allegations before a metropolitan magistrate but turned hostile during the trial and claimed the statement was made under the pressure from her father.
The girl also told the court that her father had beaten her up and compelled her to name the accused persons but denied any compromise with the accused.
"The prosecutrix has created a wrong example for the society and it is essential in the circumstances that stern legal action be taken against her so that it acts as a deterrent for others,'' the court said while sending a formal complaint for initiating criminal proceedings against her in the court of chief metropolitan magistrate.
Besides Kaur, those acquitted in the case are Sukhjinder Singh, Karamjeet Singh and Narender Pal Singh who were tried following a complaint with Tilak Nagar police station in west Delhi in September, 2008.

It doesn't say if the guys are minors. If they are, it seems they shouldn't have been named, at least it seems that way morally. Not that the law is particularly moral.

"The prosecutrix"
This is an intersting title for a false accuser. It reminds me of the title " dominatrix ". The only difference I see are, a dominatrix is hired to inflict pain/punishment while, a " prosecutrix" is not hired by the person(s) they inflict pain/punishment upon.
Prosecutrix reminds me of one particular prosecutor here in Nashville; Kathy Morante.

So the girl was beaten by her father, forced to lie about a rape by her father, and SHE is going to be prosecuted?
If it were her MOTHER who made her make the false accusation, I bet people here would jump to condemn her and want her to go to jail too. But 5 comments and no one even mentions the role of the father. Maybe I need to check back later to see if anyone condemns the man.

First, is there any evidence that the girl's father beat her and forced her to lie? I'm sure the authorities there are questioning him and investigating him for possible child abuse. If there is any evidence, I'm sure it will come out.
Unless you have some proof that her father beat her (other than her word), then no, I'm not going to condemn him for abuse. SHE lied about being raped. And now we have to believe her again when she states that her father beat her to make her do it? Convenient, and once again, it's all the big bad MENZ fault. At what point do you start to hold the female accountable for her lies jeana?
She, and she alone told the lie, unless you have some form of proof otherwise.

At what point do any of you EVER hold a guy accountable? EVER? It is NEVER a guy's fault, is it? But we are to believe the man's account each and every time. Not me.
And this doesn't surprise me that there was not one person here who even considered that the girl was in a no-win position. No, let's all feel sorry for the man. And while we're at it, let's feel sorry for her father!

Well, that depends on who you ask. If you ask the gender and radicals feminists, the answer; yes it always is, is carved in stone.
You ask me, the answer is; only if he IS at fault.

The way I see it, and the way it is, a woman's word is taken most of the time as pure gospel, while the man's word is held to the flame, as if he is a chronic liar.

I would have taken that into consideration had she put that information up front with her accusations against the young men. Speaking of no win situations, there are who knows how many men and boys who are in no win situations when they are accused of rape(s), sexual assault(s) and other violent crimes against women and girls, and they do not have the financial resources to fight the accusation(s) made against them. This is one of the reasons why some men and boys plead guilty to crimes they have not committed. IMHO, the system has been trained to be anti male.

I have no doubt there are plenty of people who feel sorry for the girl, even though she did something wrong. She falsely accused some young men of rape. Who would feel sorry for them if she had allowed the case to go to trial and the young men were convicted and sentenced to years in prison because of her lies? It is hard for me to feel sorry for anyone who causes harm to an innocent person or innocent people.

She lied about being raped. Then, when questioned about it, turned and blamed someone else for making her lie. The fact that she lied, means that anything else she is going to say, is suspect at the very least.
And no, I'm not going to blame the father. There is absolutely nothing that proves he did anything she states, other than her word (and considering she lied about being raped, her word is pretty much worthless at this point). You know, the innocent until proven guilty problem.
And once again, you have completely ignored the fact that 4 INNOCENT men were accused of something they didn't do. And SHE is the one who says they raped her. Period. That is her fault.
Even IF pressure was exerted by her father, she had to make the choice to bend to that pressure. Ultimately, she made the choice.
Ok Archivist, the lesson that you and the moronic Indian judge want females to learn is: choose between being beaten (maybe to death) by your father or rot in jail. And you wonder why barely anyone ever takes the side of you people.
What makes you think the indian judge wants any woman or girl to choose between either of those? I would say if there were evidence that the father had beaten his daughter, the judge would have seen to it the father was punished.

As opposed to simply believing all of the BS that " if a woman/girl claims she was/has been raped, she should be believed no matter what?
Even with proof that false rape accusations are a growing crime world-wide, the authorities still jump out of their skins to arrest a man or boy simply accused of rape, only to discover that the " victim " made the whole thing up. As far as being barely believed, the proof that false rape accusations are becoming more commonplace validates the points of those of us who are speaking out against the heinous crime of falsely accusing someone of rape.
