The federal hate-crimes law was expanded today to include gender, and some have raised the possibility that a rape claim, such as the infamous Duke lacrosse non-rape, could be encompassed by it: Obama signs hate-crimes bill into law: "As law professor Gail Heriot notes, 'Some have even called for federal prosecution of the Duke University lacrosse team members–despite strong evidence of their innocence.' Advocates of a broader federal hate-crimes law have pointed to the Duke lacrosse case as an example of where federal prosecutors should have stepped in and prosecuted the accused players — even though the state prosecution in that case was dropped because the defendants were actually innocent, as North Carolina’s attorney general conceded (and DNA evidence showed), and were falsely accused of rape by a woman with a history of violence (including trying to run over someone with her car) and making false accusations."
Of course the lunatic fringe of feminism will want all instances of rape to be classified as "hate crimes" against women. We've already seen some feminists seek "hate crime" status for any crime committed against women. You read that right. See here
The fact is, it is possible that more men are raped than women, because of prison rape, so women do not have a monopoly on being victims of rape.
But men, on the other hand, do have a monopoly on being victims of false rape claims. If a hate crime is defined by the fact that a victim is targeted due to his or her membership in a social group, then virtually every false rape claim (except those lodged against, for example, a female teacher) should be classified as "hate crimes."
How could it be otherwise? With a false rape claim, a false accuser specifically, purposefully, and calculatedly singles out an innocent person from a distinct class -- males -- and tries to destroy his life by claiming he was the perpetrator of a heinous rape.
One might quibble and assert that merely because the false rape accuser singles out males, she is not motivated by a "hatred" toward males and, therefore, this is not a hate crime.
Not motivated by hatred? Perhaps some of her best friends are males? Or perhaps it's akin to "The Godfather" -- it's not personal, it's strictly business, so it can't be a hate crime? Unfortunately, that argument doesn't stand scrutiny.
If a criminal came into town and started shooting only blacks, or only Jews, or only women, or only gays, or only Hispanics -- would anyone doubt that the act amounted to a hate crime, regardless of the criminal's twisted rationale? But somehow a different analysis must apply when the victims of the crime are males (including dreaded white males)? Must the hate be personal loathing toward the group targeted, or can it include cold-hearted, calculated indifference?
I am not endorsing hate crime status for any crime, but if any crime should be classified as a "hate crime" based on gender, it is the false rape claim.

False accusers feel about men the way little kids feel about ants when they dump a bucket of water on an ant hill. They don't necessarily "hate" them, they just feel like killing them, for whatever reason. If you're the ant, what does the reason matter?

the whole hate-crime legislation seems legally contemptible to me.
we're essentially saying that to kill someone, or rape them, or steal from them, solely based on race or gender or some other category is worse than the crime itself. this is strange because isn't it bad enough that a criminal kills someone? why does he/she need to be penalized further because it was racially-motivated? murder is murder! all murder is equally horrible. why make one type of murder worse than others? is the life of a black man, or a latina taken mean more than someone who was killed for no reason at all?
as for this new law, i can't believe that actually made it into the bill. honestly, i have no idea why in our society we feel the need to legislate our values. although i can see why in the twisted logic of feminists that they'd congratulate this new law's passage, i don't understand why everyone else is behind it to. has the country become this feministed? i guess...

False rape,sexual assault and, other false accustaions/claims of violence against women should also be classified as hate crimes as thay target a whole gender, males.

This bill is a hate crime
I myself think each member of the 'group of 88' (or whatever it was called) is guilty of hate crime - in the form of slander or something. There must be some way to nail those fascists.
I pretty much agree with you Zek. This hate crime stuff is just another symptom of a larger problem, that is, the relatively recent phenomenon of what I call 'personalization of crime'. For example letting victims or relatives of victims give emotional testimony on how a crime has affected them psychologically, or some such thing, and then basing a sentence partially on that testimony (though 'unoficially', I'm sure).
This is a breakdown of jurisprudence. (I believe it is even related to the 'old West'/mob mentaility, but that's another subject)

The hate crimes bill is a way of giving a special hug to women and guys and letting them know that politicians appreciate them. It's touchy-feely bullshit. It has nothing to do with any real life problem and is yet another distortion of the legal system, elevating women above men in yet another situation. And as usual, we pretend that women are the ones who are discriminated against by society, not men.

Zek, I noticed that one of your interests is philosphy. My blog in which I analyze various movies, has so far used things from certain Medieval philosphers, and Buddhist teachings. Though it is not a 'philosphy blog' as such, as ultimately I am just using that to find the underlying meaning of each movie (Silence of the Lambs, Pulp Fiction, etc.)
All circumcisions should be classified as hate crimes as well-Oh wait,-That's Not even a crime yet!
