Off-topic: Sotomayor's 'white male' comment

"I would hope that a wise Latina woman, with the richness of her experiences, would more often than not reach a better conclusion than a white male who hasn't lived that life." Sonia Sotomayor, Berkeley California, October 26, 2001.

The White House and others say that Supreme Court nominee Sotomayor's remark has been "taken out of context." Read the speech yourself here. I don't know if that assessment is especially helpful, or accurate.

I submit that important nuance is missing from knee jerk appraisals that "she's a bigot" and "no she's not." I don't think she's a bigot, but I think her worldview on gender and race needs to be understood in order to assess her.

Let us start with the statement itself. Let us construe and interpret Judge Sotomayor's remarks in a manner she would find familiar -- the way a judge construes and interprets the words of a contract or statute. The common law has developed, over the course of hundreds of years, a sophisticated way of reasonably construing the written words people choose, as reflected in various canons of construction, and even though a speech is not a contract or a statute, those principles are helpful here. For example, it is a canon of construction settled beyond dispute that all the words in a document must be read together and given effect, if reasonably possible. Words that are clear and unambiguous on their face -- and by any reasonable measure, the Sotomayor statement at issue is clear and unambiguous -- should not be rewritten under the guise of interpreting them. People are presumed to choose their words carefully, and clear and unambiguous words -- even in isolation -- should not be discarded as mere surplusage.

Judge Sotomayor's "white male" statement seems to be an isolated one. The gist of her speech suggested that a judge's gender and race informs his or her perspectives and influences his or her judgments. Among other things Sotomayor said: "However, to understand [the values and needs of people from a different group] takes time and effort, something that not all people are willing to give. For others, their experiences limit their ability to understand the experiences of others. Other simply do not care. Hence, one must accept the proposition that a difference there will be by the presence of women and people of color on the bench." She noted that even when white males have reached decisions affirming equality, they typically have been helped in arriving at those decisions by persons of disadvantaged groups.

Lani Guinier, a professor at Harvard Law School, defended Sotomayor's remarks, writing in The New York Times that "cognitive psychology and history predict that every justice acts from a perspective." With all due respect, that doesn't really address the remark at issue. That addresses Sotomayor's larger point, the gist of her speech.

I noted above that Sotomayor's statement was an isolated one, but that doesn't mean it should be discarded as mere surplusage. In fact, the statement can be reasonably construed with, and not do violence to, the larger purpose of her speech. But it should not be assumed that Judge Sotomayor didn't mean to say precisely what she said, or didn't intend her words to have precisely the effect they are now having.

The White House wants us to chalk up the words as a mistake -- akin to a slip of the tongue or a classic scrivener's error -- both the President and the White House spokesman have said that Sotomayor would reword the statement if she could. We likely will hear Judge Sotomayor clarify that statement to say pretty much what Prof. Guinier said. Declaring that the statement wasn't worded correctly is, of course, different than saying it was taken out of context. If some people have concluded that the statement expresses bigotry against white males, perhaps that conclusion follows precisely because the statement wasn't worded correctly, just as the White House has suggested.

The obvious point needs to be acknowledged and not swept under the rug: every clear and unambiguous bigoted comment that has forced a white celebrity to be fired or to go running to apologize to Jesse Jackson is claimed by some to have been "taken out of context"-- from Imus to Jimmy "the Greek" to Michael Richards -- the list goes on and on. In contrast to Judge Sotomayor's prepared comment, each of those remarks were extemporaneous statements uttered by persons no one considers serious thinkers; certainly none of them are in the business of choosing their words carefully as Judge Sotomayor is.

But let us be fair. It would be a stretch to conclude that Judge Sotomayor's comment is indicative of a worldview that Latina women are generally inherently superior to white men. She likely meant Latina women make superior judges when it comes to issues important to disadvantaged groups. Her statement likely manifests a perception that white males have not always answered the needs of groups she perceives as disadvantaged.

It is on that worldview that Sotomayor needs to be assessed. That is why it is unhelpful and inaccurate to compare her to David Duke on the one hand or to insist her "white male" comment has been "taken out of context" and leave it at that.

The judge does not deal with whether the special needs of men (e.g., in family law court, or when falsely accused of rape) have been answered by male judges, or otherwise. Her focus is on the needs of other groups. Perhaps she feels -- as do a great many feminists -- that men's needs are more than adequately protected solely because men represent most of the persons in power. That would be something readers of this blog would like to know.

More interesting for our purposes is this statement from the speech, which suggests that some male lawyers may need to undergo a process of self-assessment to acquire greater sensitivity to the needs of the disadvantaged: "I also hope that by raising the question today of what difference having more Latinos and Latinas on the bench will make will start your own evaluation. For people of color and women lawyers, what does and should being an ethnic minority mean in your lawyering? For men lawyers, what areas in your experiences and attitudes do you need to work on to make you capable of reaching those great moments of enlightenment which other men in different circumstances have been able to reach."

Her comment was both racist and sexist. If a white male had made the same comment in regards to a hispanic female or, any female, there would be cries to have him burned alive at the stake.

The point isn't just whether the statement is specifically racist or sexist (which it is), but also it shows the stereotypical beliefs about white males which are prevalent in our culture.

White males are the only allowable target group for hate in our society. That is why people like Renee don't have a problem with statements like Sotomayors.

It sounds to me asthough Sotomayor is unable to reason at the highest levels because she doesnt understand that some men are capable of administering justice fairly to those outside of their own race or gender.

many women project their own prejudice (and who they themselves are) onto the charactor of men, and think that that is the way men also think. That is not the case for a number of men, who are able to set aside (infact, dont even see) differences of race or gender. These men are only interested in truth and justice. Not all, ofcourse, there are 'bad apples' in all professions.

But If you deny these talented men the opportunity to achieve justice (for whoever that may be, man, woman, hispanic ,white), then it is ultimately the public which suffer.

There could ofcourse, be other reasons why Sotomayor says the things she does, perhaps shes playing to the female/minority audience, but to indirectly suggest that white men as a group cannot administor justice to those outside their own race/gender, throws up a huge red flag about someones ability to reason.

This, to me, is the troubling part. What exactly does she me by "a better conclusion"?

If we look back to a previous Hispanic nominee, Miguel Estrada, the chief complaint from the left about him was that, as an Hispanic, he did not act in a manner to selectively forward Hispanic causes - in other words, he did behave like an Hispanic activist, but rather in accordance to the law and the constitution.

The liberal left basically expects that non-white people should alway act from a race-first consciousness. A black judge is expected to always consider what is best for blacks ahead of what is best for all people, an Hispanic likewise look out for Hispanics interests first, and so on.

(Ever notice how many blacks harbor a highly vitriolic hatred for Clarence Thomas? He refuses to consider race in making decisions.)

In their none too subtle soft-racism, well-off white liberal elitist tend to believe that only they are enlightened enough to understand the needs of everyone else beneath them (I personally know way too many of these sorts).

So, when Sotomayor speaks of "a better conclusion", what I tend to believe she means is one that considers the interests of the people of her ethnicity as primary to the interests of all other races/ethnicities.

This sort of thinking is entirely out of line with the Constitution, and against what I what would prefer for judges to do; but the left has long preferred "activist" judges.

In my estimation Sonia Sotomayor, once confirmed (I believe this to be a forgone conclusion) will always act as an Hispanic activist in her decision making from the bench. Just my $0.02

It's OK to murder them, prevent them from gainful employment, force them to live in rest stops and under bridges.

It's text book Nazi-ism. First they came for sexual deviants - rapists, molesters, gays.

That's how it all began.

No one in any segment of society spoke up about it, just as they don't these days.

Arguably, some of these guys truly ARE dangerous to society, and need to be put away forever.

There is, however, a concerted effort to sweep as many people as possible into the 'sex offender' pogrom. Innocent or guilty, man, woman or children - all are caught up in this terrible debacle.

Protective laws and rights dating back to the Magna Carta has been dismantled in order to achieve this.

It's as if Voncel Johnson has been thrust into a bizarre social experiment.

Forcing so many men to live like post-apocalyptic trolls beneath a bridge in the middle of Biscayne Bay wasn't quite mad enough. Now they've added a woman.

For two years, a colony of convicted sex offenders under the Julia Tuttle Causeway has lived in a public health travesty, without water or toilets or electrical service. They sleep in tents, shacks, the back seats of cars in the last realistic address in metropolitan Miami unaffected by city and county sex-offender residency laws.

The numbers have been growing steadily as more convicted sex offenders emerge from prison and are consigned to finish out their wretched lives under a bridge.

The population was up to 52 men Monday. And Voncel Johnson.

GENDER EQUITY

In a peculiar nod to gender equity, the Florida Department of Corrections informed her last week that she too had only one residency option in Miami-Dade County -- the Tuttle. ''They just give me a blanket and a pillow and sent me . . . here?'' she asked, talking over the incessant thump-thump-thump of the freeway traffic overhead. ``I just broke down.''

A community backward enough to create a subterranean de-facto prison camp of male sex offenders thrusts a single woman into the mix -- just to see what happens.

I am not a sex offender but I continue to speak up for them. This has put me in a very unpopular position. I don't consider committing sexual offenses a right. I have not seen any article or amendment in the U.S. Constitution that makes exception of sex offenders. Most people would like to see them put away forever but, it is not going to solve the problem or end the creation of broad and vague laws that are, in my opinion, on the verge of making it a sexual offense to pass as within one hundred feet of a woman or a child. It own't put and end to the hysteria that fuels the witch hunt.

I speak out against the trampling of basic human rights that are now acceptable by 'good' society.

It's totally Nazi Germany tactics - disenfranchising one segment of undesirable society, imposing laws and sanctions upon them no human would tolerate otherwise, and selling it to a willing public.

Sadly, injustice for one is injustice for all - more and more un Constitutional laws are now being imposed upon the 'good' citizens, more and more registries are being introduced and forced upon us.

Just to share an expirience:
I digg a solution to grab Youtube videos. Some of are sites where you put the url from YouTube and it gives you file with strange extension and small size. Some are really complicated.
My way was to use moviesherlock (moviesherlock.com or sm like this - please ask me - will rememeber). Really simple utility, that just works, and only 1 button in software.

Who knows - youTube results are same for same text? I likes cat (Simons cat / dog).
Why doesn't youtube allows to download its movies without external tools?!! It actually sucks!
