Amanda Baynton charged for false rape claim

To hide an alleged incident of domestic violence, Amanda Baynton, in collusion with her soon-to-be ex-husband, filed a false rape report so he wouldn't go to jail. The lengths to which some will go to avoid trouble are astounding. But how long before we hear: "He convinced her to file the report so he wouldn't go to jail," or "he forced her to file this report. It's his fault." My guess . . . not long.

OCALA - A 21-year-old Ocala woman who told police a man held her at gunpoint, took her to her apartment and raped her was arrested Monday and charged with false report of a crime.

In late October, Amanda Baynton claimed she was at her Oakhurst apartment and that when she went outside to retrieve something from her vehicle she felt an object pushing on her back, according to police. She claimed a man with a Hispanic accent told her it was a gun and that if she screamed he would kill her and her child.

Baynton told police the man took her back to her apartment, hit her in the face with his hand and raped her.

Investigating the case, Ocala police Detective Michael Green discovered inconsistencies with the woman's story. Green saw Baynton at the Marion County Courthouse during her divorce hearing Monday and asked if she could come to the police department for further questioning.

At the station, Green confronted Baynton with her story, and the woman told the official she made it up. She said she and her husband, Derek Baynton, were arguing when he reportedly hit her in the face. Thinking he may go to jail, the woman said both of them made up the rape story.

Amanda Baynton was arrested and taken to the Marion County Jail. Officers will check with the State Attorney's Office to determine whether they will pursue any charges against her husband.

She must have been looking to protect her alimony income stream.

But, what exactly did she plan to do when the police started rounding up and dragging in random Hispanic men for a line-up?

Would she have simply continued to NOT identify a suspect, or would she at some point "picked" some guy who didn't have an alibi - and who would therefore be put through the ringer in an attempt to get evidence or a confession out of him.

These women who make these charges thinking only of their convenience fail to consider what might happen to innocent men during the quest to find their "attacker".

To be fair to the police, they simply cannot ignore a claim of a violent stranger rape. They would be guilty of gross negligence should they fail to act an another victim suffer because of their inaction.

This is why claims of the nature in this story will have police in a heightened state. Those patrolling in the area will be "keyed up" with adrenaline.

My own sad prediction is that at some point we are going to have one of these false rape claims lead to the shooting death of an innocent man, who just happened to look like the description of the mythical attacker, and who didn't respond quickly and appropriately enough to police.

If anyone here has been a view of "Law & Order: SVU", I give you the frequent over-aggressive reactions of the two lead characters (Stabler & Benson) when they believe they are dealing with a rapist.

My guess is that there are plenty of would-be Olivia Benson's out there among the female officers of the world, who "style" themselves after their heroine.

How long before one of them encounters an innocent man believed to be a rape suspect, thinking "What would Benson do?", and ends up shooting the man dead because she interpreted something he did as threatening (in her over-agitated state of rapist-hatred).

Personally, I don't know how such a scenario has not yet played out, given societies hared of rape/rapists and women free-wheeling tendencies to throw out false claims as they see fit.

slwerner, I agree: "To be fair to the police, they simply cannot ignore a claim of a violent stranger rape."

Stranger rape is very rare. My problem is arresting acquaintance rape suspects immediately, on the basis of the woman's word alone. Police need to exercise greater discretion. We see reports here constantly where men are arrested even though evidence shows they could not have done it.

I say, issue restraining orders to keep the evil men away from the delicate rape accusers until you are damn sure.

Do your investigation quickly and efficiently.

As old and outdated this claim and information is, in the wake of recent headline news involving the same alleged victim, no doubt people will come across this page in their google searches.

Since no follow-up or updates were ever included on this site, a couple of facts that should be pointed out is that the husband, Derek Baynton, was never charged by the police as he did not have any affiliation to his wife's claims, false or alleged.

Mandatory tests required when a rape case are taken by authorities; showed proof of DNA not related to the husband on the alleged victim.

So the question might remain out there was she really raped by an unknown person - or is the truth really that she did all of this, on her own, not in conjunction with his husband in any way or fashion, to cover up something she was hiding from him as well.

Only she knows the truth, and unfortunately, I doubt anyone will ever know the full truth of the real situation.

As outdated as this article is, in light of recent headline news regarding the alleged victim, no doubt there have been Google searches that will lead people to this site.

No follow-up or update was ever provided after the initial story. The husband, Derek Baynton, was never charged with any crime by the police because he was not part of the accuser’s plan, false allegations whatsoever.

In a reported rape case, mandatory tests are required. None of which Ms. Baynton wanted to participate in because she knew the truth of the situation. The results showed proof of DNA not related to her husband, but belonging to another man.

So was she really raped by an unknown man as she originally alleged; I seriously doubt those allegations. She was trying to cover up something that she didn't want her husband to know about and he was trying to the right thing by her to report the rape. Trapped in her own web of lies, she was forced to go the police and hospital and had no choice then but to continue her lies to everyone. As the investigation continued, she was charged with the false rape story.

Only she knows the entire truth about the situation, and I doubt no one will ever know the real truth.

It's a shame that innocent people get caught up in the process of such a claim. Not only the non-existent person she alleged in her story, but even more so an innocent husband who had serious concern for the woman who was still his legal wife and took the appropriate action to get help. It was her choice alone to lie to so many people.

She was just sentenced to 15 years in prison for shooting her husband to death.
