It is better that ten rapists escape punishment than for one innocent man to be imprisoned for a rape he did not commit

As our readers know, this is among the few sites on the internet devoted exclusively to giving voice to the persons wrongly accused of sexual assaults and their unique interests. While this site is not intended to concentrate on victims of rape, that does not mean we minimize their experience in any manner. We do not.

But we need to be clear about one of our premises: As the celebrated English jurist William Blackstone said, it is "better that ten guilty persons escape than that one innocent suffer." (Commentaries on the Laws of England, published in the 1760s.) This principle so fundamental to our criminal jurisprudence that it is rarely challenged -- except when it comes to rape. Some rape victims' advocates question centuries of accepted wisdom by wondering aloud why this formulation should have any validity in the rape milieu. I respectfully suggest that these persons are often speaking from the understandable pain of victimhood or from an ideological zeal that has no place in our jurisprudence.

Our Supreme Court has, in various ways, underscored that Blackstone's formulation is one of the pillars undergirding our jurisprudence. Justice Douglas, a titan and icon of liberals for much of the 20th Century, stated: "It is better, so the Fourth Amendment teaches, that the guilty sometimes go free than that citizens be subject to easy arrest." Henry v. United States, 361 U.S. 98, 104, 80 S. Ct. 168, 172 (1959). Likewise, Justice Harlan stated: "I view the requirement of proof beyond a reasonable doubt in a criminal case as bottomed on a fundamental value determination of our society that it is far worse to convict an innocent man than to let a guilty man go free." In re Winship, 397 U.S. 358, 90 S. Ct. 1068, 25 L. Ed. 2d 368 (1970)(Harlan, J. concurring).

Is the pain of a rape survivor in seeing a rapist go free in any sense comparable to the pain of an innocent man or boy deprived of his liberty for years or even decades? The question scarcely survives its statement. Take, for example, Dwayne Dail, who was convicted of a rape he did not commit as a teenager and spent 18 years in prison. While in prison Mr. Dail was brutally victimized by the same crime that he, himself, did not commit. His life was shattered, and it is fair to assume he will never be whole after this ordeal. Anyone who thinks it is unusual for a man or a boy to be wrongly jailed for a rape he did not commit (and often a rape that did not occur) should spend several hours reviewing the accounts on this Web site.

While an individual is capable of doing terrible things to another individual, the state itself should never risk of doing a terrible thing to another human being . Putting a man on trial for a rape the evidence shows he did not commit is one such terrible thing.

A wrongful acquittal is a terrible thing, too, of course. And, yes, convictions for allegations of rape are lower than convictions of other crimes, but there are two principal reasons for this:

(1) As FBI statistics show, false reporting of sexual assault is fourfold greater than the average for all crimes. The Politics of Sexuality, Barry M. Dank, Editor in Chief, Vol. 3 at 36, n. 8.

(2) Most rape claims are of the acquaintance variety where there is no evidence as to what occurred except from the mouths of the accuser and the accused, and they often have diametrically opposing stories.

A wrongful acquittal is never, ever the equivalent of a wrongful conviction, and to suggest otherwise is morally grotesque. The victim of a rape is not at risk of losing her liberty for decades if her rapist goes free. But an innocent man imprisoned for a rape he did not commit, like Dwayne Dail, is usually destroyed by the experience, as are the lives of his loved ones -- including the women and children who depend on him.

Accordingly, we reject, and cannot engage in discourse with persons who suggest, that a wrongful acquittal is the moral equivalent of a wrongful conviction. Dictators throughout history have asserted such moral equivalency as a pretext to ruthlessly imprison, torture and murder the innocent to insure their enemies are also snared. It is a monstrously barbaric -- and singularly un-American -- practice. The reason the Blackstone formulation retains its validity is self-evident. It is the very hallmark of a civilized society.

I agree with this entirely.

One should also bear in mind that rapists, just like false accusers are of course a very small part of the population, but they both casue such mayhem due to the fact they are often serial offenders.

Thus it should be possible to catch most of them eventually.

No-one wants anyone to be falsely imprisoned, but given it's almost impossible to ensure rapists are imprisoned for rapes they *did* commit, yes, perhaps 1% of rapists get convicted and many of those get laughably light sentences.
Some actual verifiable data.

the problem here gentlemen, is that you cannot reason with an animal.

Women are animals in a constant state of survival. Animals are selfish, and as such become destructive to others around them. just look at the wild responses to this thread.

Women are a tragedy, but that is not the fault of men. that is something they should take up with mother nature.

We as men have done our best for them, at the expense of ourselves, our children and our now broken societys.

I wish all men would try and do their best to help women and vice versa, I don't see why it should be an us and them situation. Rape hurts everyone doesn't it.

Anyway, my comment on this was to say that, is it better that ten victims get to see their rapist go free to rape again, ten juries don't understand rape, ten victims' families suffer, ten more communities are put at risk, ten more partners suffer with their frightened traumatised spouse/partner...than to see one innocent person in prison.

I don't know how to answer that until we make the public more rape-aware and faulty investigations are put to a stop

One innocent man jailed is by far worse than 10 that go free, the very basis of our entire judicial system would crumble under any other suggestion
as to the above posters..both male and female....grow up, ranting and insults have never in the history of mankind solved a single problem

How to start, hmmm. I hate rapists! I have seen their cruilty and destruction at work and the aftermath of their actions. I have seen alot of female friends in my life raped. Most of the rapists went free even though the victims showed evidence of being raped. Yes placing an inocent man in prison is wrong but allowing a accused person that did commit the crime is worse. Worse meaning that they have the chance to commit it again and they will sooner or later, destroying another innocent persons life. Since 1970 to 2008 there has been about 2,956,245 people raped in the US alone, and thats the ones that called the police. A untold more are still out there. Placing rape into the capital punishmet list would serve better in allowing convicted rapists the death penetly. In doing so it would place a wedge in a rapist's mind stating if I do this I could die. Of course for all you people out there thinking that that is barbaric, the convicted should be held for a certain amount of years in prison to make sure the alligations are 100%. An jail time should be served for those people that make false alligations, lets say something like 2 years for lying should be enough. But its either that or we stay the same as we are and then lets see it if you like finding out some of your friends commited suicide cause her rapist beat the hell out of her, raped her and left her for dead.

In the event that a rape actually has been committed, convicting the wrong person does not provide a measure of safety against future offenses. Instead, IT LETS THE REAL RAPIST GO FREE!!!!!

Let's think this through...

Rapist goes free = bad.
Rapist goes free + innocent man convicted = WORSE!!!

Its bad enough that criminals go free. But a justice system that recklessly convicts innocent people will become as dangerous as the criminals from which it is meant to protect us! Innocent people will not know from which side of the law they will be assaulted next. As respect for the law deteriorates, there will eventually be no law to protect anyone, and that's a much bigger problem than you and your personal trauma.

Life is harsh. We have to live with people getting robbed, raped, murdered, and seeing the same happen to their friends. That's bad enough already. What's worse is the chaos of a society full of angry firebrand-waving victims haphazardly taking out their suffering upon one another.

This is crap going both ways. On one hand, you have genuine victims of rape who have a hell of a time just getting the accusation out. Hopefully they act within the first 24 hours so a rape detection kit can be used to check her and look for all other physical evidence. She is in for a bad time no matter how it goes. The stress, horror, and pain of what they went through I can barely comprehend and it deeply hurts my heart.

On the other hand, False Accusations are devestating to everybody involved in the mess. The man is likely to face all types of social, mental, emotional and legal problems even though he is innocent that it will haunt him just like a rape victim. The proving that the accusation is false seriously hurts future rape victims credibility due to one person's need to make another suffer by using the legal system as a weapon.

It's total damage either way and worse rape victims are going to suffer either way. A false accusation destroys her credibility due to anothers lies. A man's life is shattered beyond repair due to somebody's lies. Real rape victims can't be heard due to false accusations.

If one rapist escapes justice it is just as bad as an innocent going to jail. The reverse is true as well. One innocent man should not be punished for a crime that he did not commit. These aren't eggs we are dealing with people, were you have to break a few to make an omelet. These are people's lives being destroyed by both rapists and false accusers. Both groups need to be persued and brought to justice equally.

I also agree with steve "woman are animals' but i would go 1 step furthur, they are lying scheming devils with out 1 shred of moral decency, and have no capacity for love or compassion..these terms are alien to the animal species known as woman...they are also the most self centerd group of animals creation has ever seen, they only ever do things out of self interest, especially in the area of sex which makes ALL WOMAN are whores as well....theres not a supercomputer powerful on earth that could ever calculate the irreparable harm that these "beasts" known as woman have caused society and destroyed the lives of millions of men and families....men need to wake up

i now teach my young son TO NEVER EVER HAVE SEX WITH A WOMAN, for to do so is suicide, both financially, physically, mentally, and spiritually...if you have to have sex, then i teach my boy to film the entire act leading up to and finishing, as the lying whore could turn around and say it wasnt consensual....we need to start protecting men!!! we are an endangered species

You are all ignorant idiots for thinking that this blog is wrong. I myself am up on charges or sencond, third and fourth degree sexual assault because a drunk 36 yr old woman said I shoved my hands down her pants and penetrated her leaving a scratch on her butt.
She is saying it happend in a bar in front of people. I have a surveilance tape from the bar and also several eye witnesses that saw and know I did not ever touch her. All we did was dance. She made this up because she is crazy and looking for attention. Even with all of my witnesses and a surveilance tape this justice system is set up to protect all claims of sexual assault. I am 21 yrs old and fighting with all I have to prove my innocence,
I have had to drop out of college in which i was a 3.7 GPA and planend on attending law school next year just to try and prove these allegations false. My career is possibly ruined even if not convicted because it will always be on the internet for people and employers to see.
BOTTOM LINE; People are by our constitution "Innocent until proven guilty" The fact is is that in these cases innocent men can be convicted based only on heresay and no evidence once so ever. It is as if the innocent men accused are actually "Guilty untill proven innocent" and if they cant afford to they go to jail and get raped themselves. Open up your eyes you ignorant assholes.

I can say as a victim of sexual assault that as years go by, the pain lessens. I had snuck out that night and was too afraid that I would get in trouble to tell anyone what happened for several years after the incident, and even with the offender walking away and nothing ever coming of it, I still healed and moved on with my life. It probably took about 5 years to get my interactions with men back to normal, but that is nothing compared to the 10-20 years of living with prison every day that these innocent men have to suffer, not to mention being labled a sex offender for the rest of their lives. And what about the other men that same woman falsely accuses because she is not called to answer for her crimes?

And for those that say "who cares about the falsely accused" because they are some nameless, faceless mass that mean nothing to you personally, I ask, what if it were you, your father, brother or husband that was being locked up because they were a convenient target in some narrow-minded adolescent cover up or became the target of a vindictive ex? Would you realize the importance of having someone stand up for the rights of the accused then, or would you feel that your relative was an acceptable loss in the fight to stop rape?

And one final thing - for those that think this never happens, in my 29 years in this world I have personally MET 2 women that bragged about falsely accusing their exes to get back at them, 2 women that falsely accused a man of hitting her because he wanted to leave her and she wanted to make sure she got the kids and 2 female rapists that targeted men using date rape drugs. These are not people that I heard of in some story, these are people that I KNEW during the time that they committed the crimes and I was physically present for some or all of the battle. Add in the ones I heard first hand about and I can't even count anymore. This is sad and it diminishes the credibility of real victims, and if women need to stand together for something, we need to stand against these liars first and foremost because they are the reason so many guilty go free.

Just put a bullet thru the heads of any bitches who falsely accuse men of rape. Either way, the man will go to jail for a LONG time. So, might as well dispense summary justice yourself to the woman, cause it won't change the prison sentence much.

This makes me feel physically sick. Victims of rape have to suffer a LIFETIME of imprisonment inside their own heads, trauma, anxiety and lack of trust. Nearly all rapists go free, whereas a tiny percentage are falsely imprisoned so which seems like the bigger issue here hmm? Stop invalidating the suffering of rape victims you misogynistic, victim blaming pigs.
